Texas Ranger Sgt. David Armstrong, investigated the murder of Botham Jean and said, the investigation leads him to believe authorities had no probable cause to arrest Dallas Police Officer Amber Guyger for any crime.

So police can shoot an unarmed man in his own home and walk away from it?

Think a bit about that statement. The issue comes down to intent, which is a necessary element for prosecution of a crime. That's for a jury to decide, which, I suppose, is why we have juries in the first place.

IIRC her claim was "well,I was tired and stressed out after a long shift"...or something of that sort.

Having worked in a big city ER for years I had many,*many* long and stressful shifts. Sometimes 8AM to Midnight...sometimes 4PM to 8AM.But never once,after such a shift,did I enter someone else's home and start shooting.

Lets turn this around. If a Black male cop was startled by an unarmed white woman who he didn’t believe should be where she was and then he shot ad killed her then should he not be charged?

If they are that on edge that they are that jumpy and that trigger-happy then perhaps they shouldn't be police officers?

If that happened just before this incident that *might* be considered a mitigating factor in her case. If not then it's of no significance in *this* case.

Those of us who served in the military can all recall the stresses of "long shifts". Going (nearly) sleepless for 4-5 days during tac evals were par for the course. My first two years in Germany, I was pulling staff duty officer at least once a week, often more. That was followed by a full day at work the next day.

The mental gymnastics being performed in support of Amber are worthy of Olga Korbut.

So if she did not intend to shoot him but was just reacting to a situation then the killing is justified? What about the scenario I outlined in reply 25. Should the police officer be charged with a crime?

Not guilty of premeditated murder, but would seem to be guilty of a lesser charge? I feel sorry for her, but one cannot just kill innocent people and face no consequences.

Police need to be judged by the same standards as civilians.

If a civilian CCW had walked into the wrong apartment, and shot a police officer he found there, does anyone doubt he would face charges?

E.g. While speeding* I run over you. I obviously didn't intend to run over you, but run over you I did. So in your mind I didn't commit a crime?

*A somewhat lesser offense than breaking into someone's house
