Supreme Court: Suspending Parliament was unlawful, judges rule

Boris Johnson's decision to suspend Parliament was unlawful, the Supreme Court has ruled. Delivering its conclusions, the Supreme Court's president, Lady Hale, said: "The effect on the fundamentals of our democracy was extreme."

She added: "The decision to advise Her Majesty to prorogue Parliament was unlawful because it had the effect of frustrating or preventing the ability of Parliament to carry out its constitutional functions without reasonable justification." Lady Hale said the unanimous decision of the 11 justices was that Parliament had not been prorogued - the decision was null and of no effect - and it was for the Speakers of the Commons and Lords to decide what to do next.

When you have no written Constitution, the Courts are your Constitution.

And even when you do have one, the Courts are your Constitution.

Given the Supreme Court’s more limited powers, compared to its American counterpart, despite Tony Bliar’s changes, can Boris simply ignore or bypass this ruling?

Ir is past time for the British people to rise up and throw off the yoke of oppression. A good start would be to hang those who are blocking the will of the people, but I don’t think there is enough of Britain left to resist the globalist/EU tyranny.

Parliament cannot vote on anything unless they come back into session. To do that, they would have to defy the Queen, who, I believe, technically was the one who ordered them to disband, at the PM’s request.

Lady Hale spoke like a true socialist supporting, unpatriotic Progressive, no future Royal Order for her.

Boris is following the will of the people expressed in the Brexit Referendum, and as such was perfectly justified in proroguing an obstructionist Parliament which was acting in bad faith to prevent Brexit, the true will of the nation.

It's a bit one-eyed to treat the referendum vote as the only democratically legitimate thing in play here.

The House of Commons has democratic validity by virtue of the last general election.

The Brexit referendum has democratic validity by virtue of the fact that the House of Commons chose to refer a particular question to the electorate.

Trying to argue that one of these has priority over the other is inevitably circular, and therefore sterile. For better or worse, they are both legitimate, and we have to make the best of the confusions that result.

It will be for constitutional historians of the future to use this as an object lesson of the risks in trying to mix representative democracy with direct democracy.

Yes, but the Brexit referendum happened before the current Parliament. It is the will of the People. The current Parliament has no authority to thwart the will of the People.
They exercise their authority to traduce the will of the people, and therefore what they do is illegal in fact.

The Parliament is cruising for a revolution to happen. Let them press.Heads will roll in the next election.

The People will win in the end, they want to remain British and do not want to be “ Euroweenies.” That’s why Boris is so strong, he has the People behind him in a populist movement that has the liberals and socialists screaming and falling on their swords. That’s why the last thing that Parliament wants is another election. But its going to happen sooner or later.

Exactly! That should be Boris’ position. ie, as Prime Minister, I’ll do what I want. If you don’t like it, you can hold a vote of no confidence and put the issues before the people. The one thing we will NOT do is stick me in office but not in power and refuse the British people a say.”
