Uber will refuse to comply with a new bill passed in California Wednesday that says they must reclassify their drivers as employees rather than contractors, arguing that drivers aren’t core to its ride-share business model. Known as AB-5, the bill requires companies in the state - such as Lyft and Uber - to treat workers as employees by providing them with the full benefits and protections the designation necessitates. Under the motion’s terms, the title of employee must be issued to any worker the company exerts control over in terms of performance of their task, or if the role carried out by the worker is central to the employer’s regular business. But in a dramatic push-back, Uber’s chief legal officer Tony West voiced confidence over drivers being able to maintain their independent status irrespective of the bill -insisting drivers are not central to the company’s operations.

Good reply to anyone who disputes their workers are somehow not employees. This company makes the bad old employers of the early 20th century look good.

How about any independent contractor that provides a service to you, like the guy who mows your lawn, paints your house, handymen, gutter cleaning, carpet cleaning...the list is endless. Are they all going to be unionized or become employees?

I’m guessing the taxi drivers, their unions, companies are behind this. I picked one of my daughters up at DFW yesterday and didn’t see a single taxi cab. Just What appeared to be Uber and Lyft vehicles. Lots of big black Suburbans, Tahoes, etc.

Farmers are not central to the operation of the Chicago Board of Trade, it’s just a market that enables sellers and buyers. Uber does the same thing.

I believe that the original idea was for a free & willing association of states.

“These United States”, i.e., these independent States who have chosen to unite to form a more perfect union...

That notion was laid to rest in 1865.

That is an old, outdated concept of employee vs. contractor, which Uber has abused.

Not sure what you mean. I work as a contractor. I don't need the government to force my clients to give me things I may not particularly want from them.

I get asked to do runs not commanded to do runs.
My relationship is as a business with another business.

I LIKE Uber. It’s especially great overseas, where you can get a reliable ride at a good price without having to speak the local language or use local currency. I’ve used Uber in U.K., Ukraine, and Poland as well as many US cities.

The only problems I’ve had are higher rates during peak hours and a snowstorm. When the driver goes out of the way to “save time” and raise charges it’s easy to contact Uber and get an instant refund of the overcharge.

Unlike others, I often get drivers who’ve been doing it for 2 years or more. I usually tip a little. Who knows, maybe I’m a better ranked customer sought out by better drivers, which in turn gives me a better experience.

Should Governor Gavin Newsom sign the bill into law as expected, more than one million contractors across the state of California are set to be affected, including janitors, construction workers and beauty technicians.

Doctors, insurance agents, and real estate agents, were all made exempt from the bill after months of jostling between lawmakers.

This definition would eliminate pretty much all independent contractors if applied to all commercial activity.

Uber has ignored the law and regulations from day one.... why would anyone expect them to obey new ones, when they never followed existing ones.
