Judge Throws Out Suit Against Sheriff Over Immigration Detentions

An illegal alien’s class-action lawsuit, in which he claimed a Virginia sheriff violated his constitutional rights by detaining him at the request of U.S. Immigration and Customs Enforcement (ICE), has been thrown out by a federal judge.

The law enforcement officer who was sued, Culpeper County, Virginia, Sheriff Scott Jenkins, told The Epoch Times that he’s satisfied with the legal outcome.

“I am pleased that this lawsuit seeking preferential treatment for criminal illegal aliens within our justice system has been dismissed,” Jenkins said.

“This judge confirmed what people with common sense have known all along—my actions as sheriff, in cooperating with federal law enforcement authorities on illegal immigration, are completely legal and constitutional. Those arguing otherwise are out of touch with the concerns of our entire community and country. Spending time and money helping repeated lawbreakers escape the rightful actions of law enforcement is incomprehensible.

“I appreciate the enormous outpouring of support from our community as I pushed back against these attacks. I will always stand firm on this and other constitutional issues while protecting our community,” he added.

The case itself goes back two years.

Francisco Guardado Rios was arrested Aug. 13, 2017, for two misdemeanor offenses under Virginia law: driving without a license and contributing to the delinquency of a minor.

The foreign national was placed in the custody of the local jail, which is managed by Jenkins. The same day, ICE delivered documents requesting Rios be held beyond any scheduled time of release for 48 hours, because it had determined there was probable cause to believe Rios was an alien deportable from the United States under the Immigration and Nationality Act (INA).

This will go on for a few more years until the La Raza Racistas grind it down as they did in the West.

It happens no more and illegals now enjoy special rights to do pretty much anything and cannot be detained unless a squad of ICE guys jump them in an alley and spirit them off into the night.

Just a matter of time before police in the East get the same boot on their backs.

I would LOVE TO THINK that Trump’s appointment of CONSERVATIVE JUDGES has something to do with him (and thus the United States) WINNING a bunch of recent rulings. But then I think of...

...the TROLLS here who INSIST that Trump is no better than Hillary (although they don’t say it outright), and therefore these ‘victories’ would have have happened with Hillary-appointed judges.

So I’m confused. Should I trust the trolls here, who INSIST that Republicans are no better than Democrats, or should I trust those recent rulings?

After all, if I believe that Republicans are actually better than Democrats, then I would look at their near-perfect record in confirming Trump’s judges and say that it is a GOOD THING for the country, as opposed to sitting out elections...because there are a relative handful of non-perfect RINOs.

Life is tough...so I’ll think about the options.

Different world then. Back then, the Dems figured the higher courts would overturn District Judges...not so much now, with Trump placing real conservatives, with RINOs supporting him, in pretty much all through the higher (i.e., Appellate) Courts.

Too bad for the Left, enough RINOs hung on to keep Republicans in the majority. Had the RINOs lost to Democrats, I doubt that Trump would have been able to place ANY judges on any court, including the SUPREME COURT.

So I’m glad to see that enough conservatives HELD THEIR NOSE and did the right thing in the November elections (voting for RINOs in the Senate) - or else Trump would be POWERLESS and the 2016 election would have been meaningless.

You're right - having the R by the name gives us power. RINO or not - it keeps us in the majority. I don't understand why people don't get it.

It gets so wearying to hear the “conservatives” on this forum pull the knives out for Repubs who may have done a great thing today, but eff ‘em because something happened 10 years ago that didnt meet with the couch potato’s approval.

Excellent court decision. The importance of it is that while it is a state/local case, the ruling could be used by ICE/cooperating law enforcement agencies in sanctuary states/cities/counties such as Montgomery County, Md. where there have been 6 rapes/sexual assaults, etc by illegal aliens against young children and boys (or arrests for acts now under arrest warrants).

Montgomery County head Mark Elrich, a hardcore leftist ahole, supported by the possibly Soros-aided Maryland State’s Attorney General Brian Frosch, have said that local law enforcement cooperation with ICE is illegal according to their executive orders. NOT.

I think a popular revolt is starting in both far-left Montgomery County and the more conservative Frederick County because of city/council rules, laws, and executive orders by leftist Democrat leaders have been used to protect illegal criminal aliens from being legally handed over to ICE for criminal processing and possible deportation.

People are sick and tired of these leftist aholes endangering them and their children/grandchildren by sheltering and releasing illegal alien criminals from further justice by ICE/state government agencies, etc.

My only wish, besides a tar and feathering, is that the wife or daughter of someone like Erlich or Frosch is raped and/or killed by one of the illegal aliens they protected and released back into society.

PERHAPS, only then, will they reap what they have sowed on the rest of law abiding society.

It has come to this, by design, funded by Soros and other far-left foundations, staffed by hardcore Marxists and Hispanic reconquistadores, and all a part of a national plan to destroy our immigration/border security laws and protection systems.

Just look at the groups involved in defending the illegal alien criminals, who leads them (former Obama Secy of Labor Tom Perez was one, now the head of the DNC, and former leader of the Marxist Casa de Maryland), and who funds them.

Time for a Sen. Judiciary Com. investigation and open hearings so that the public can see who the traitors are.
