Trump officials say children of some service members overseas will not get automatic citizenship

The Trump administration said Wednesday that the children of some U.S. military members and government employees working overseas will no longer automatically be considered United States citizens.

U.S. Citizenship and Immigration Services (USCIS) issued a policy rescinding previous guidance stating that children of U.S. service members and other government officials abroad are considered “residing in the United States” and automatically given citizenship under a section of the Immigration and Nationality Act (INA).

USCIS issued a clarification to the rule later Wednesday, explaining that the new rule would only affect three categories of people: Children of non-U.S. citizens adopted by U.S. citizen government employees or service members; children of non-U.S. citizen government employees or service members who were naturalized after the child's birth; and children of U.S. citizens who do not meet residency requirements.

The policy change triggered backlash from immediate Democratic lawmakers and presidential candidates.

“This move by the administration will make it harder for Americans serving our country overseas to have families,” wrote Rep. Val Demings (D-Fla.). “This also appears to be an initial step towards ending birthright citizenship, something which the president has threatened to do—and which would be unconstitutional."

Not true. The basis for citizenship in those cases is not “born in the US.”


US residency for the parent. Say the military parent is born abroad and would not otherwise qualify under the new rule.

US military members and government workers who are NOT citizens.

I was born in Europe in the 1950’s to a non-citizen, and I was adopted by 2 US citizens. My parents applied for my citizenship when we returned to the states, and I became a naturalized citizen when I was 5.

It sounds to me like President Trump is following ‘“The Law of the Blood” citizenship and eliminating citizenship under “The Law of the Soil”. You must be the natural born child of American citizen to be one. If not, you must become a citizen through naturalization. That was the practice of the USA when I was adopted, and it is the practice in most countries of the world.

“The new policy is aimed at children seeking to acquire citizenship through what is known as the derivation process, a fast-track to citizenship for children of U.S. citizens.

“To derive citizenship, children must fulfill a residency requirement. Under previous regulations, living in a home abroad with their U.S. citizen parents fulfilled that requirement; the new rule will require that residence to be on U.S. soil.

“These children will now need to apply for citizenship under Section 322 of the INA, which considers them as born and residing outside the United States. That provision requires them to apply for naturalization, which must be completed before the child turns 18.”

Its good to tighten up these types of rules to discourage abuse and engender appropriate respect for U.S. sovereignty. The status of “Naturalized Citizen” shouldn’t be given away like candy.

This policy does not affect children born outside the United States who were citizens at birth or who have already acquired citizenship, including children who:
  • Were born to two U.S. citizen parents, at least one of whom has had a residence in the United States or one of its outlying possessions before the child’s birth;
  • Were born to married parents, one of whom is a U.S. citizen and one a foreign national, if the U.S. citizen parent was physically present in the U.S. or one of its outlying possessions for at least five years, at least two of which were after they turned 14 years old;
  • Were born to unmarried parents, one of whom is a U.S. citizen and one a foreign national, if the U.S. citizen parent meets the requirements listed in INA 309;
  • Are otherwise eligible to receive a Consular Report of Birth Abroad (CRBA) or a Certificate of Citizenship documenting U.S. citizenship acquired at birth; or
  • Are residing in the United States in the legal and physical custody of their U.S. citizen parent after being lawfully admitted to the U.S. for permanent residence.

I know it is against tradition but the headline in this case is quite deceitful.

Exactly. People need to read the article and understand it. There's nothing wrong with this policy. It's no different than if a citizen living in the USA adopted a child from another country. There would need to be some hoops to jump through before that adopted child could be a US citizen. If someone had a child before becoming naturalized then that child would not automatically be a citizen unless the other parent was. It's all just common sense.

This is a lie. Trump officials made it clear that there is already a federal law in place to make children of US federal employees born overseas US citizens. Another lie from the media.

If both parents are non-citizens of the US, and a child is born on foreign soil, the patents may apply for the child’s citizenship.

It would be no different for them than if visitors from another country brought their child here. Since neither parent is a US citizen; the child would not be one either.

Same with illegals bringing children here. None of them should ever be citizens because they did not come here legally.

Children born in the US should get special status, regardless of the circumstances.

Not if neither parent is a legal citizen. That's the very definition of anchor baby. That loophole needs to be closed by any means necessary.

Birthright Citizenship was anathema to the Founders of our Republic ... and they very carefully provided against granting it in the US Constitution

children born of parents who are citizens of foreign nations are born citizens of those foreign countries.. not USA...

President Trump is more wise than any of us, and his wisdom should not be questioned.

Excuse me? "should not be questioned."?

Patriotism is supporting your country at all times and your government when it deserves it.

Questions should be asked and answers given if the answer doesn't affect national security.

Actually at one time children of the military were not automatically citizens if they weren’t born on post or other US “territory”. My sister was born in 1942 in Panama in the same hospital McCain was born in. She discovered she was not a citizen years later when she tried to register to vote. It was quite a mess.

Yes. Should not be questioned. If over the last few years President Trump has not earned your trust, then feel free to leave. He is more wise than you, and has more strategic and more complex plans for the evils that imperil is than you and I can comprehend. That’s what made him a billionaire several times over and the greatest living leader to grace this country in centuries.

Is it likely? No. Is it possible? Yes.
Whether or not I like the man, trust the man, or anything else - President Trump is doing exactly what he said he was going to do while he was on the campaign trail, and I do admire the man for that.

Step daughter was born in Japan. But both her parents were US Citizens as her dad was US Navy and they lived in Japan 2 yrs. She was registered as both a Japanese citizen and US. Had her US Passport and BC at 3 days old from the US consulate.
