A federal appeals court has set aside deportation orders for two Guatemalan nationals because the Pennsylvania state trooper who pulled over the van they were riding in for speeding allegedly inferred that the two men were present in the country unlawfully based on their appearance.

The officer lacked the authority to enforce civil immigration law because Pennsylvania has no agreement with the federal government that would allow state agents to perform the functions of immigration officials.
Cool I am going to go to Pennsylvania and violate all sorts of federal laws because the local police cannot arrest me.

Never mind that the officer was as accurate as could be.

Two of the judges, Thomas Ambro and Midge Rendell, were appointed by then-President Bill Clinton.
Judge Rendell is the wife of Ed Rendell, who was previously governor of Pennsylvania from 2003 to 2011, and who, from 1999 to 2001, headed the Democratic National Committee.

And that's our problem. Our duly appointed judiciary is deliberately violating the laws of America by rewarding law breakers. Like that liberal whore judge who enabled a wetback to escape law enforcement by ushering him out the back door?

If the republicans could take backthe house in 2020, they are two more judges for the impeachment and removal list.

So police can use their “judgement” or powers of observation anymore. Great. [/s]

So police CANT use their judgement or powers of observation anymore. Great. [/s]Correct. It has been this way for a long time, especially in liberal enclaves (NY, Chicago, LA, Seattle, Atlanta, DC... et al). Is it any wonder they are overrun with crime?

In an opinion written by Judge Rendell, the appeals court agreed with the two men that their constitutional rights were violated when the trooper unreasonably extended the stop to investigate their immigration status.
They were stopped for speeding. When a citizen is stopped for traffic violations, we are required to show ID. Do illegals have constitutional rights, and do they have special rights?

Was this a 3-0 decision? I don’t seem to be able to find that information. In any case it was only heard by 3 judges.

I think Ill start manufacturing guns & designer drugs and drive at speeds to maintain a high service level to my customers that request delivery.
After all, police cant suspect that Im up to no good.
Also, Im going to sue if the police label as a suspect.

Judge Rendell
Any connection to Fast Eddie, the former governor??
How about when coppers extend their traffic stops to investigate a potential drug use, like holding someone there while they fetch a police dog. I guess that is OK but what happened here is not???
