Groups tries to stop Trump’s border-wall efforts in Arizona

Environmentalists have asked a judge to stop a plan to replace existing vehicle barriers along the U.S.-Mexico border in Arizona, arguing the Trump administration unlawfully waived dozens of laws as part of the project that will ultimately damage wildlife habitat.

The injunction request filed Tuesday seeks to halt work on 68 miles (109 kilometers) of replacement barriers at Organ Pipe Cactus National Monument, Cabeza Prieta National Wildlife Refuge and San Pedro National Conservation Area before the start of construction on Aug. 21.

...The injunction request was made in federal court in Washington, D.C., as part of a lawsuit challenging the waivers granted for the Arizona portion of Trump’s border wall efforts. Similar challenges to such waivers have been filed in California, New Mexico and Texas.

The California lawsuit failed when a judge rejected arguments that the administration had overreached by waiving environmental and other reviews. The challenges in New Mexico and Texas remain alive.

Site prep (clearing) and delivery of materials has already begun. The article mentions 21 August as a deadline, but I think that is tailored to influence the court. Other reports indicated that groundbreakings would start next week.

The waiving of these legal requirements is very explicitly stated in law (Real ID Act of 2005), and the Administration has done it for all the wall built so far. It has already been challenged and upheld in Federal Court - they have no new argument to make, just a different venue

There is no merit to the lawsuit, and virtually no chance of it ultimately succeeding.

These are the same groups (e.g. Center for Biological Diversity) that have been repeatedly filing these harassing attempts to delay.

I wonder who is behind this group?

Not having the project is currently hurting the lives of American humans!

Here is a published report, indicating that groundbreaking on DoD wall segments (in Arizona) will start on 21 August.

This is the first date that I have seen mentioned. I have been hearing that contractors were moving shortly after the Supreme court ruling, and that wall panels were starting to be piled at the work sites, and that other deliveries and preparations were being made.

This indicates that they were issued Notice to Proceed by the Contracting Officer(s). After that, their performance bonuses are tied to timely delivery.

I expect the situation is similar in New Mexico, which is not part of this injunction request. So New Mexico groundbreaking could literally be any day now, but likely within the next two or three weeks.

Center for Biological Diversity’s sole reason for being is to file lawsuits.

That place is no fragile ecosystem. And there is barely anything living down there but cactus and the hardiest of desert plants.

That is some of the hardest terrain I’ve ever traversed. And it’s much harder when it’s 115F.

Who is actually behind the Center for Biological Diversity is a very good question. They have also been trying to harass ranchers out of business for many years.

Years ago I hiked and camped in Organ Pipe. It was virgin desert and untouched by human hands. Now, it is a garbage ridden cesspool due to the swarms of scumbags trekking through it. Damn crime. It needs a wall yesterday, and F* the green weenies who think they know what they are talking about.
