Categories of Prohibited People
Giffords Law Center ^ | Not Listed | Not Listed

Posted on 08/06/2019 12:44:56 AM PDT by FtrPilot

Federal law prohibits the purchase and possession of firearms by people who fall within certain categories, such as convicted felons, domestic abusers, and people with specific kinds of mental health histories. Although background checks have prevented over 3 million people in these categories from obtaining guns, federal law does not generally include other types of people identified by public health researchers as being at a significantly higher risk than the general population of being dangerous, including:

-Those who have been convicted of violent or gun-related misdemeanors.

-Those with a history of abusing alcohol or drugs.

-Those convicted of juvenile offenses.

-Additional people who have suffered from severe mental illness.

We’ll make it a chant instead of a song, so that it will be easier for non-singer participation.

-Those with a history of abusing alcohol or drugs.

That opens the door to confiscate from anybody whose ever had a DUI.

THIS is the area to address!!!!

What percentage of mass killers would we have missed using this additional data?

Of course stealing the weapons from parents or others aren't precluded by these additional constraints.

This quote struck me.
“The parts of the brain responsible for impulse control, judgement, and long-range planning are among the last areas of the brain to fully mature, and in fact, may continue to develop until at least age 26.”

Yet they are talking about lowering the voting age to 16...

Noticed they didn’t include doctors as a new survey says they commit Suicide at high rates. https://www.painmedicinenews.com/Online-First/Article/07-19/Physician-Suicide-Statistics-Spark-Discussion-Of-Culture-That-Stigmatizes-Mental-Illness/55551?sub=11B22924EF6783FCEB2C8D2FC673DC5A5825E15F92FB318F546528377A7B24A&enl=true&dgid&utm_source=enl&utm_content=1&utm_campaign=20190805&utm_medium=title&fbclid=IwAR0I9Yc1iVdKkF0BKHOhlmzWuqL1ym2ln1tqO4Lqk1yoc3bNOmBj6VKBSWE

By there standards Any one with PSTD would be pre-cluded. As I suspect the parents of a Murdered Child would be. I fit both, the PSTD is my child’s Murder. Do I admit to it to medical NO. Simple I control it, it does not control me.

“background checks” ...... I want somebody to show me where in the Constitution it says that you have to ask permission from the federal govt. to arm yourself. That is what a “background check” is. Asking permission. In fact the 2nd Amendment says exactly the opposite. What part of “Shall not be infringed” do they not understand? Gun control is not about guns. It is about control. The only reason they want a disarmed population, is because they want to do things that they know damned well that a well-armed citizenry would never allow.

They first have to figure out a all-in-one database that each and every Federal, state, and local law enforcement agency must use, which I think is how think these type of people are getting access to weapons. Think of the rollout and cost of the Obamacare website debacle.

Then there’s the cooking of the statistics book to make crime rates appears to be less than actually are for political reasons across the spectrum.

I agree...the recommendations by the Giffords Law Center are not what I would agree to. However, I could support a kid that gets suspended or expelled from school could go on the list until they reach a certain age, perhaps 24 or 25. Same would apply for any kid found guilty of a violent crime in the juvenile justice system.

I would also like the list to be updated as law, passed by Congress and Signed by the President. Not updated by BATF as a policy or a rule.

I would like to add to my previous post that:

Red Flag laws are not the answer.

I hope that President Trump understands that.

No free man should (shall) ever be debarred the use of arms.

So said Jefferson. Anyone who cannot be trusted to be armed should not be running around loose.

If a homo cant buy a firearm for this reason do the leftists fight for “his” 2nd amendment rights?

Homosexuals are mentally ill, so they shouldn't be armed anyway. But if they're not locked away, they should retain the right- free men.

I believe the Federal Courts have ruled it legal, and large majorities of people agree with it. That said, I agree with you and I am more of an absolutist on this question. But check your logic because this could mean you are saying that even “prohibited people” should not be prohibited. Where does it say that a criminal loses his/her right to self defense?

With this push to restore (voting) rights to criminals, why one and not the other?

I have always believed that when a convicted criminal completes his sentence (including parole, probation, fines, costs, etc.) ALL Constitutional rights should be restored.
