DOJ will not prosecute Comey for leaking memos after IG referral: sources

The Justice Department has decided against prosecuting former FBI Director James Comey for leaking classified information following a referral from the department’s inspector general, sources familiar with the deliberations told Fox News.

“Everyone at the DOJ involved in the decision said it wasn’t a close call,” one official said. “They all thought this could not be prosecuted.”

Comey penned memos memorializing his interactions with President Trump in the days leading up to his firing. He then passed those documents to a friend, Columbia University Law Professor Daniel Richman, who gave them to The New York Times. Comey admitted to that arrangement during congressional testimony.

Comey signed one of the FISA requests, and that investigation is still outstanding. I’m not going to get angry, or go off half-cocked about this, but will wait for all the investigations to be completed.

They went after Trump into his presidency and jailed his associates and bankrupted them, but they still won’t do anything? I didn’t believe that Trump was going to go after Hillary after he won, but I thought they would do something after the witch hunt.

But Comey and others inside the FBI and the DOJ during his tenure still face legal jeopardy in ongoing probes by the IG and Barr-appointed special prosecutor John Durham. Those investigations are focused on the origins of the Russia investigation that included a Foreign Intelligence Surveillance Act (FISA) warrant targeting the Trump campaign at the end of the 2016 election, the source said.

Just because the DOJ isn’t going to prosecute Comey for that leak doesn’t mean that Comey has been exonnerated of it, or anything else. It just means they decided not to prosecute him for what they have on it.

Don’t get me wrong. I am under no delusion that someone under Trump wouldn’t get treated differently than Comey. I just wouldn’t assume that he is out of the woods.

My guess is that the DOJ had an immunity deal in place for Comey already.

Otherwise, he would have been a damn fool for even showing up to testify before Congress about these matters.

Here's something else to consider: It would be impossible to prosecute anyone for this sort of thing if the person doing the "leaking" knew information being "leaked" was 100% false.

Think about this last point for a moment. In order for the DOJ to prosecute this case they'd first have to prove that the information in Comey's memos was TRUE. The difficulty in proving that in a court of law is actually a very important weapon for President Trump.

What if the DOJ is focused on rolling Comey over his obvious lying and leaking as they seek even bigger fish? What if their target is not Comey but Clinton or Obama?

What if..>What if... but the truth is, no, no one is going to face justice. There are two sets of laws in America now. Trump's DOJ is in full support of that.

P.S. to my last point.

A prosecutor could not prove the contents of Comey's memos were true without calling President Trump as a witness.

I'd be shocked to find a single Freeper who finds THAT scenario plausible.

Nothing will come of that, either. You need to accept that there are indeed 2 sets of laws in America, and Trump's DOJ is only confirming that.

What about all those people who were prosecuted for doing the same thing Comey was excused for? Should they be pardoned and paid damages? Barr did not have to say anything! Just let it lay.

I refuse to accept a justice system for one group of people and a different justice system for others; such a system will end our Constitutional Republic sooner or later. Let's not let that get started. Besides, I want some proof that any of these miscreants will be prosecuted at all; have we seen any guarantees? Now at the {2-year} starting gate things do not look encouraging so far.

If these people get let off...then I am not voting in 2020. That is it, if there is no justice, then I am no longer involved. I hope Trump and Barr are going to do what is right. I am hopeful.
