Sen. Ted Cruz raises religious liberty concerns with Trump's federal appeals court nominee

One of President Trump’s federal appeals court nominees is facing opposition from advocacy groups and at least one Republican senator, who told the judge Wednesday there are serious concerns about his judicial record when it comes to religious liberty.

Sen. Ted Cruz, a member of the Judiciary Committee, expressed doubt during Judge Halil Suleyman Ozerden’s confirmation hearing about whether he’s the type of constitutionalist the Texas Republican wants to see on the 5th U.S. Circuit Court of Appeals, which hears cases from Texas, Louisiana and Mississippi.

Halil Suleyman "Sul" Ozerden (Turkish: Halil Süleyman Özerden) (born December 5, 1966) is a United States District Judge of the United States District Court for the Southern District of Mississippi and a nominee to be a Circuit Judge for the United States Court of Appeals for the Fifth Circuit.

Ozerden was born in Hattiesburg, Mississippi. He obtained his undergraduate education at Edmund A. Walsh School of Foreign Service at Georgetown University in Washington, D.C., receiving a Bachelor of Science in Foreign Service. Sul was also a four-year Navy ROTC scholarship student, serving as battalion executive officer (1989). Upon receiving his commission as a naval officer, he completed United States Navy Flight School in Pensacola, Florida, from 1989 to 1990, and was designated a naval flight officer. Ozerden also obtained his Juris Doctor in 1998 from Stanford Law School, and served as associate editor for the Stanford Law Review.

Ozerden has come under particular scrutiny for granting the Obama administration’s motion to dismiss a case from the Catholic Diocese of Biloxi that challenged the Affordable Care Act’s contraceptive mandate in 2012. Ozerden said that the case was not ripe for a formal decision because of the regulation’s status.

Sen. Mazie Hirono, Hawaii Democrat, asked the nominee why he joined the Federalist Society, an organization of conservative and libertarian lawyers, earlier this year. [...] Ms. Hirono suggested the judge recently joined the legal group because of the opposition he faced from conservatives.

Kinda looks that way.

This particular nominee SHOULD not make it out of the Senate Judiciary Committee. Don’t even bring his name up for a vote Lindsey. Simply being the personal friend of a member of the President’s staff is NOT sufficient to be an appeals judge ... remember Bush’s friend Harriet Meyers?

On the recommendation of United States Senators Thad Cochran and Trent Lott, President George W. Bush nominated Ozerden to be a United States District Judge for the Southern District of Mississippi on January 8, 2007.

IIRC, the contraceptive mandate rule was not finalized in 2012. That means the judge applied the law, regardless of political opinion from anyone.

Does anyone here know differently?

I cannot find any definitive date in an online search.

Islam requires muslims to see sharia replace our Constitution.

Protecting President Trump from himself by stopping a nominee he shouldn’t have nominated. The judge clearly has no regard for the constitutional guarantee of freedom of religion.

I think you are probably right. A good president can make a bad pick. Eisenhower nominated Earl Warren, probably the worst justice the S/C has ever known!

Eisenhower’s nomination of Warren was a political payoff. Neither he nor Bob Taft had a majority going to the convention and Warren, then Governor of California, was the state’s favorite son. He gave his delegates to Ike for a nomination.
