President Trump is considering an executive order to try to move forward with a citizenship question on the 2020 census, top sources tell Jonathan Swan and me.
"We didnt come this far just to throw in the towel," said a senior administration official with direct knowledge of the conversations.
Former federal judge J. Michael Luttig, who has longtime ties to officials in the administration, told Axios:
"If the president of the United States were to issue an executive order, supported by his full Article II powers, directing that the citizenship question be included in the 2020 census, I believe the Supreme Court would affirm the constitutional power of the president to include the citizenship question in the census.

Same here! Census worker started asking questions in a sneaky way to get info. I told her she was trying to trick me. She got flustered, denied it and walked away. LOL
The census is a power of the Congress, not the President.
How much is the costly April follup? It could be worth it. What are they going to do if you don’t answer accurately? If they can find the information to hang you in other ways, why do they need a census?
“Top Kek.”
Never heard that term before, so I looked it up. It means “good.” I don’t understand your response. Are you saying it would be good for Congress to impeach Trump?
Yep, it would be OUTSTANDING if this catches on. Our way of negating the effect of the Illegals. There’s ABSOLUTELY NO VALUE in conservatives filling out census forms in Blue States, as the only results that I know of is getting more seats in the House and maybe bumping up federal dollars a bit...but I doubt that even that is anything more than peanuts, if that, since, as far as I know, virtually all federal money to individuals is doled out by how many sign up, not state population, and money for other stuff (such as highway projects) is mostly doled out by need.
In fact, I think the reason why politicians make the money claim is that they fear losing a seat or two, which would pit some of the incumbents against each other - but they know enough that the public isn’t going to give a crap about that happening.
The Census Bureau became a permanent agency within the Department of Commerce and Labor following passage of An Act to Provide for a Permanent Census Office in 1902. In 1913, in became part of the Department of Commerce upon its separate establishment.
Trump has the authority as Secretary of Commerce is an agency under his span of control
Therefore he has the authority NOT Congress
Nice try
Obama left behind “a pen and a phone”. Maybe Trump is using them.
I managed to avoid the census in 1980, 1990, and 2000 due to a fairly mobile lifestyle (working away from home most of the time, either that or my workplace was my home for the duration of the job). I’ll likely be in the process of moving when the 2020 census takes place, so they might not get me then, either.
And having a hard time understanding why Trump doesn't force a white-shoe outside legal counsel upon Census, which is loaded with AFGE -- second only to the VA, I believe -- and picks their lawyers according to that bad seed.
But at least on cert the White House can insert itself into the legal arguments.
Yes they can!
Reason for including citizenship question on the census:
How about, we want to know how many citizens there are.
(Shakes head.)
Smells like troll.
He should take the position that the SC has determined that including the census question is constitutional, thus any other remarks are just that — remarks.
In 2000 I was politically ignorant and dutifully filled out the whole census form. Prior to that my ex-husband filled them out.
“Smells like troll.”
It’s rather amazing how you fill the room with it so quickly.
John Roberts is gonna mad! Watch out for his gay meltdown!
The Census Office only carries out the directives of the Congress.
In fact the 1902 Act clearly states exactly what information the Office could collect for that particular census.
Congress never gave up their authority.
Would love to see the President go against the lower courts especially on immigration and the wall. Lincoln did it, this situation with political hack unelected judges going against the POTUS has to stop.
In a popular quotation that is believed to be apocryphal, President Andrew Jackson reportedly responded: "John Marshall has made his decision; now let him enforce it!" This derives from Jackson's comments on the case in a letter to John Coffee, ". . . the decision of the Supreme Court has fell still born, and they find that they cannot coerce Georgia to yield to its mandate."
