Today the Supreme Court issued two major opinions with profound implications for American politics. It blocked, for now, adding a question about citizenship on the 2020 Census in Department of Commerce vs. New York . In Rucho v. Common Cause , the Court permanently killed off allowing federal courts to decide that a legislative map gave one side too much of a partisan advantage.
It was a bad day for the right, a very bad day for the left, and an extremely bad day for Chief Justice John Roberts.
First, the very bad day for the left. For years, the institutional left has been trying to strip state legislatures of power and give it to federal courts. They wanted federal judges to have the power to say that a given legislative map helped one political party too much. For example, if a state voted 52 percent to 48 percent, then state and congressional legislative lines should apportion power in roughly the same percentages. If they didn't, federal courts should get to decide the legislative lines.
Giving federal courts the power to rule on partisan imbalances in legislative lines has been a top priority of Democrats and leftist process hounds for years. Why? Because the vast majority of America, when considered state by state, leans right and elects Republicans to majorities in state legislatures. They wanted federal judges in those states to blunt the power of state legislatures.
Today the Supreme Court drove a final stake through the heart of partisan gerrymandering cases. They are done, dead, RIP. Consider this their obituary.
The Court ruled that these are political questions, that the Constitution vests power in state legislatures to draw their own lines and to set the rules of line drawing. Power should reside with the people, not federal courts with life tenure.
That makes it a very, very bad day for funders who had poured millions of dollars into the left's efforts to have federal courts erode decisions made by Republican state legislatures.
But in another decision, it was a bad day for the right and those who want to collect data on how many aliens are in the United States. The Court blocked, for now, the proposed citizenship question on the 2020 Census.
If that wasn't bad enough, Chief Justice John Roberts cast the deciding vote along with the four liberal justices. Writing for the Court, Roberts agreed that Secretary of Commerce Wilbur Ross had the power and authority to add the question, but something just didn't smell right.
Over the last few weeks, the ACLU has bombarded the Court with letters, missives, complaints, and self-proclaimed bombshells containing conspiracy theories on the "real" origins of the Census question. It's not as bad as O.J.'s quest for the real killer, but it's close.
Naturally the compliant leftist media at CNN and the Washington Post has had an endless parade of stories. See, they know who still takes the mainstream media seriously, and today they won five votes to block the question.
It's a shame that five votes validated these extracurricular mob tactics after the briefing was complete. It provides a roadmap for future last-minute efforts to influence the Supreme Court. One suspects Chief Justice Janice Rogers Brown or Chief Justice Edith Jones would not have sided with the left to block the Census question. Whether or not the citizenship question can still be added to the Census before the printer needs the final proofs remains to be seen.
I’m with you.
The miserable legacy of GW Bush continues on.
There was another lousy decision with The Fool Roberts casting the deciding vote, Kisor vs Wilkie.
This case would have advanced the deconstruction of the administrative state, the unaccountable permanent government that rules by bureaucratic dictate.
But the treacherous Roberts betrayed conservatives once again, just as he did in Obamacare.
#MeToo
“If only Ron had LISTENED to Nancy and picked Kemp for VP “
Jack Kemp would have been a disaster. Kemp was a hardcore supporter of illegal aliens and he would have made GHW Bush look good by comparison.
Reagan should have chosen Paul Laxalt as VP for his second term. Laxalt was known as Reagan’s “First Friend”, they were close personally as well as politically. Laxalt had been Governor of Nevada when Reagan was Governor of California.
Harvard Law School seems to be overlooking teaching law students about major constitutional problems (imo) with states allowing non-citizens to vote.
From earlier threads today
Justice Roberts misguided (imo) opinion on this issue aside
Todays concern for voting fraud in renegade, Democratic-controlled states that allegedly want to use the illegal votes of undocumented Democrats to overthrow the constitutional republic is nothing new.
More specifically, the congressional record shows, regarding discussion related to the drafting of the 14th Amendment, that the federal government needs to know who its citizens are in order to be able to protect and defend the Constitutions Uniform rule of Naturalization Clause (1.8.4) and Section 2 of the 14th Amendment.
"Article I, Section 8, Clause 4: To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;"
14th Amendment, Section 2. Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens [emphasis added] twenty-one years of age in such State."
Here are specific concerns about protecting the voting power of citizens and the Constitution.
" If the States can admit to the elective franchise those who are not citizens, thereby neutralizing the votes of citizens, not only the Federal power of naturalization becomes a nullity, but * * * * "a minority of citizens by the aid of aliens may control the government of the States, and through the States the government of the Union [emphasis added]." Appendix to the Congressional Globe, 1868. (See near middle of 1st column.)
" Whatever difference there may be as to what other right appertain to a citizen, all must agree that he has the right to petition and also to claim the Protection of the Government. These belong to him as a member the body politic, and the possession of them is what separates citizens of the lowest condition from aliens and slaves. To suppose that a State can make an alien a citizen or confer on him the right of voting would involve the absurdity of giving him the direct and immediate control of the action of the General Government [emphasis added], from which he can claim no protection and to which he has no right to present a petition." Appendix to the Congressional Globe, 1868. (See bottom half of 1st column.)
Regarding PDJT's uncommon common sense argument that we don't want illegal alien criminals entering the US and harming US citizens, Justice Joseph Story had reflected this same concern decades before the civil war.
" As the free inhabitants of each state were entitled to all the privileges and immunities of citizens in all the other states, it followed, that a single state possessed the power of forcing into every other state, with the enjoyment of every immunity and privilege, any alien, whom it might choose to incorporate into its own society, however repugnant such admission might be to their polity, conveniencies, and even prejudices. There is great wisdom, therefore, in confiding to the national government the power to establish a uniform rule of naturalization throughout the United States. It is of the deepest interest to the whole Union to know, who are entitled to enjoy the rights of citizens in each state, since they thereby, in effect, become entitled to the rights of citizens in all the states. If aliens might be admitted indiscriminately to enjoy all the rights of citizens at the will of a single state, the Union might itself be endangered by an influx of foreigners, hostile to its institutions, ignorant of its powers, and incapable of a due estimate of its privileges [emphases added]. " Justice Joseph Story, Article 1, Section 8, Clause 4 (Citizenship), Joseph Story, Commentaries on the Constitution 3:§§ 1098--99, 1833.
It's not surprising that PDJT is keeping his eyes open for Democratic ballot box fraud in 2020 elections.
Patriots need to support PDJT in working with the states to allow only citizens who present valid citizenship / photo ID cards to be allowed to vote, such cards scannable and / or containing security chip to facilitate vision-impaired Democratic voting officials.
Patriots also need to elect a new patriot Congress in the 2020 elections that will not only promise to support PDJT's vision of MAGA, now KAG, but will also promise to uphold their oaths to protect and defend both citizens and the Constitution.
Remember in November 2020!
MAGA! Now KAG!
I guess the liberals really don’t want us to know how many illegals are in country today. That would outrage the citizens to know that the 13 million number they have been claiming since about 2000 is a complete lie.
There’s no “they”. Roberts is just being who he is.
He’s exactly what you should have expected to get from Bush jr.
Roberts’ performance today tells me that Obama is still blackmailing him, and telling him when to jump, and how high. Prophecies have said Roberts is one of the current or former Supremes who will wind up in prison. Please Lord, let it be so. The man is selling his Nation to cover his @$$.
The illegals will lie anyway - they broke the law to get here - I highly doubt they care about lying on the census.
Back in engineering school one of the profs said something like “And if it doesn’t smell right - it was probably solved using the left hand rule.” (Then motioning as if he was pulling something out of his butt with his left hand.)
Of course then it was up to us to prove why the solution was wrong. Not bang the gavel and go sit down.
I think Roberts doesn’t smell right. I go along with many of the others that think the Liberals have something on him.
It would make my day if RBG announced after they adjourn that she is retired effective immediately.
Excellent article, thanks.
Both Justice Alito and Justice Thomas nailed it.
Mega Bump!
Not true. Scalia was Catholic. So is Alito. Quite a few Catholics on Scotus.
“Chief Justice John Roberts cast the deciding vote along with the four liberal justices.”
It’s astonishing how often this happens in really important cases.
“John Roberts worst Chief Justice ever appointed by a Republican.”
Well. . . there was Earl Warren.
The redistricting case was FAR more important

Here's a little bit more on those illegally adopted kids from Heavy,NYT, Time magazine:
2. Jack & Josie Were Born in Ireland

According to a Time Magazine profile on Roberts from 2005, his children were both born in Ireland, a country the Roberts family has close ties to. Irish Central reports that Roberts often attends Irish dance events in Washington D.C. and his mother-in-law, Kathleen OSullivan, is from Newtownbarry, Charleville in Ireland.
In a 2005 New York Times profile, the Times notes that the Roberts family has a home in Knocklong, in the county of Limerick.
Although the children were born in Ireland, there is some confusion about where they were adopted from. According to the Underneath Their Robes blog, an Associated Press report claimed that they were adopted from Latin America.
The exact circumstances of Roberts adoption remain a private matter. The New York Times denied rumors that it was investigating Roberts adoptions.
The Washington Post notes that McElroys book claims the children know they are adopted and even read picture books about adoption.

there's lots more but I'm tired of posting this stuff over and over and very few seem to get it.
Not really having explored all this for years now he was a true conservative but became compromised during obamacare.
