That depends on why he stabbed him. If the terrorist attacked him, zero prosecution. Otherwise, yes, you are correct.

I’ve done some research on this...here’s what I’ve read.

Gallagher has been a Seal for like 18 years with multiple combat tour and medals and has never been written up before.

He’s known as a total hard ass for details.

He’s also a trained medic.

He did cut the prisoners throat but he put in a device in his trachea to help him breathe...

What this has come down to is a hard core 18-year veteran disciplined a bunch of new navy seals who couldn’t deal with it and made allegations that have now gone on way to long...

It is not attempted murder if the victim was already dead. One big FUBAR. I’d say the Navy just ought to cut it losses now and forget about this case.

Stab below the collar bone to release pressure from the chest cavity in order to perform further field surgery, is the way the “stabbing” has been explained.

There's too much of this story that doesn't fit. Like the fact that they refused to bring witnesses in when they first charged Gallagher........all the way to the unusual way they treated him, while detained.

This sounds like someone, with a personal grudge against Gallagher, determined to take him down.

I'd bet dollars to doughnuts that if Gallagher did stab the ENEMY, it's because he felt there was a threat to him or his men.

Not always.

Feigning Incapacitation is the oldest trick. . .that is why you can kill the enemy if he has not surrendered.

If a prisoner attempts to use force to escape, you can kill him.
