Random drug tests are used, and termination occurs with a confirming drug tests shows recent use.

I could ALWAYS pass the test, no need to lose any good young workers.
My boss had been there about forever and knew a million workarounds.
Once he sent one of my team, everyone thought he was a safe bet. He never returned. And he was a very good worker too.

What about truck drivers, first responders, security guards, railway workers, miners and anyone else in potentially dangerous jobs.

Many Nevada employers require their employees to have a security clearance. Someone who has failed a drug test cannot get a security clearance. Sorry, rules are rules.

For the occasional smoker/vaper, it is very difficult to measure any effect on behavior or mental ability after 2-3 hours, regardless of the level in adipose tissue. THC taken orally has a somewhat longer effect profile.
For the addiction or dependency-prone individual who likes to stay high all the time or while working Dont hire them, bad news.

Stoners now, stoners forever. Working impaired is never a good business model.
So, does the legislation protect the employer from legal liability for acts carried out by the buzzed employee?
It’s a quandary. Insurance carriers and agencies in Nevada, for example, will have a hard time denying coverage for someone with an otherwise sensible drug testing program.
I would think that carriers would just write around covering accidents where a user is involved leaving the company naked. The companies will then chose to find drug users by guess and by golly and rid themselves ot them just as they get rid of habitual drunks that show up okay on blood alcohol.
Surely this insane law will not stand SCOTUS scrutiny?
Gotta be unconstitutional!
