A San Francisco-based federal appeals court ordered a judge Friday to reconsider her ruling against President Trumps decision to ban transgender people from the military.
In a unanimous, unsigned order, a three-judge panel of the U.S. 9th Circuit Court of Appeals told a federal district judge in the state of Washington to take into account executive privileges in reweighing her decision.
The U.S. Supreme Court put a hold on the judges nationwide injunction in January, allowing the ban to take effect while the government appealed to the 9th Circuit. Fridays decision continued that hold.
Gay rights lawyers who brought the case nevertheless said the ruling contained statements helpful to their challenge. The court held that the ban targets transgender people and must be analyzed through that lens
It also made clear that the district court was entitled to evaluate this discriminatory policy through a full presentation of the facts, which we are eager to make, said Lambda Legal lawyer Sharon McGowan.
The case, which is being heard by Seattle-based District Judge Marsha J. Pechman, began with a challenge to a policy Trump announced on Twitter in 2017 that transgender people would no longer be allowed to serve in the military.
Pechman issued a nationwide preliminary injunction against that decision, ruling that it was not a well considered military judgment.

The fact that this is even an issue before our courts is even crazier than the transgenders themselves—who are total and complete lunatics who ought to be locked up in asylums.

If a lunatic is crazy enough to whack off his pecker how in the world is one is sane enough to fight in the military.

It is not a LGBTQ ban
It is a not fit for active duty ban
It has nothing to do with their ‘Right’ to defend our country, or their ‘Duty’ or feeling ‘lesser’ than other men/women because they can’t contribute.
It has to do with the fact that if accepted, the doctors will claim they have ‘gender disformia(?)’ and then they will get a gender reassignment surgery paid off by the government.
Once they have gotten their free $100,000 surgery they resign their post.
To stop that fraudulent loophole one must ban all transgenders in the military.
Agreed. We have lost our freaking minds. There is no reason sane people would tolerate these kooks trying to push their degeneracy. We used to lock them up, because we used to recognize they are nuts.
How can it be that a Federal judge has veto power over the Constitutionally mandated Commander-in-Chief?
Will the next suit be brought by someone trying to stop Trump from protecting the nation in a military crisis?
Why can’t Trump follow the example of President Andrew Jackson, who told Supreme Court Chief Justice Marshall to go to hell?
They are going to impeach Trump anyway.
But this is NOT a homosexual ban. This only applies to transgenders.
Some here have gotten confused on that. Homosexuals and transgenders are not the same.
They may have had the lower court judge reconsider for military/executive power reasons, but there is a lot of bad stuff in this decision that will help the tranny lawyers get judges to strike down perfectly reasonable legislation and policies everywhere in the 9th Circuit. It’s not a victory.
That should read not a TOTAL victory.
Excellent but so much more needs to be done to clean up the military cesspool.
