Christian baker Jack Phillips of Colorado is facing a third lawsuit over his refusal on religious grounds to make certain cakes, the latest legal battle for the Masterpiece Cakeshop owner.
Transgender woman Autumn Scardina filed a second lawsuit against Phillips last Wednesday in District Court for the city and county of Denver, Colorado.
In the new lawsuit, Scardina claimed that Phillips violated Colorados Anti-Discrimination Act and Consumer Protection Act by refusing to bake what the plaintiff labeled a birthday cake.
The birthday cake as described in the lawsuit, which was to be blue on the outside and pink on the inside, was supposed to symbolize Scardinas transition from male to female.
Scardina is being represented by attorneys Paula Greisen and John McHugh. In an interview with local outlet CBS 4, Greisen said that the dignity of all citizens in our state needs to be honored.
Masterpiece Cakeshop said before the Supreme Court they would serve any baked good to members of the LGBTQ community. It was just the religious significance of it being a wedding cake, claimed Greisen. We dont believe theyve been honest with the public.
Jim Campbell, senior counsel with the Alliance Defending Freedom, which has represented Phillips in his past litigation, said in a statement that was mere harassment.
A new lawsuit has been filed against Masterpiece Cakeshop that appears to largely rehash old claims. The State of Colorado abandoned similar ones just a few months ago, stated Campbell, as reported by CBS.
So this latest attack by Scardina looks like yet another desperate attempt to harass cake artist Jack Phillips. And it stumbles over the one detail that matters most: Jack serves everyone; he just cannot express all messages through his custom cakes.
Over the past few years, Phillips and his Masterpiece Cakeshop have been the subject of litigation aimed at forcing the baker to provide services for events that he is opposed to for religious reasons.
Last year, the United States Supreme Court ruled 7-2 in Masterpiece Cakeshop v. Colorado Civil Rights Commission that Colorados Civil Rights Commission was wrong to punish Phillips for refusing to make a same-sex wedding cake.
The Supreme Court ruled that the Commission violated Phillips' right to free exercise of religion due to the bias showed in their application of civil rights law.
To describe a man's faith as 'one of the most despicable pieces of rhetoric that people can use' is to disparage his religion in at least two distinct ways: by describing it as despicable, and also by characterizing it as merely rhetoricalsomething insubstantial and even insincere, wrote Justice Anthony Kennedy for the majority.
This sentiment is inappropriate for a Commission charged with the solemn responsibility of fair and neutral enforcement of Colorado's anti-discrimination lawa law that protects discrimination on the basis of religion as well as sexual orientation.
Soon after, Scardina filed a complaint with the Commission against Phillips over his refusal to make a cake celebrating Scarindas gender transition. In response, Phillips sued Colorado last August.
In March, Colorado and Phillips both agreed to drop their respective litigation, with Colorado Attorney General Phil Weiser stating that both sides agreed it was not in anyones best interest to move forward with these cases.
The larger constitutional issues might well be decided down the road, but these cases will not be the vehicle for resolving them, said Weiser earlier this year.
Equal justice for all will continue to be a core value that we will uphold as we enforce our states and nations civil rights laws.
The third lawsuit is allowed because the agreement between Colorado and Phillips provided Scardina the right to pursue separate litigation against the Christian baker.
At what point do you just ignore these endless, purely harassing lawsuits?
Counter sue the pants off this hateful freak.
RE: At what point do you just ignore these endless, purely harassing lawsuits?
How do you ignore a lawsuit when government has the power to take away your property?
I agree. The judge should file a contempt of court ruling on these guys and their lawyer(s).
So the tech giants can decide who and who can not use their services, but the little bakers of cake somehow don’t have this freedom?
If there ever was a glaring example of homosexuals trying to force us to accept their lifestyle, this is it.
This person could easily find another baker to do the cake for he/she/it. But no, they don’t want that. They want us to acknowledge and accept their lifestyle OVER any religious objections we may have.
This is a classic case of one person (backed by the gay lobby) who’s actively trying to financially destroy a legitimate business.
I don’t know if a countersuit is possible or practical - but the bakery should look into this.
How do you ignore a lawsuit? Commit suicide?
When the rule of law is abused, the fallback position is not to turn tail and run. It is to hit back so hard that they fear ever violating the rule of law again.
How? By identifying every gay owned business and hit them with values from a Muslim perspective.
Let’s see... a cake for arranged marriages or genital mutilation. A burka wedding dress....
Or a Pro-Life cake
They will continue to do this kind of thing until it is no longer fun for them. No longer fun in some kind of very personal way.
Where is the line? Who knows when someone will feel they have nothing to lose and decide to make a point. A jury of his peers will decide. All it takes is one not guilty vote.
The law should protect this man.
Or worst of all, A Trump Cake...
That would be a good sting operation... How many liberals would make a Trump for President cake...? If they did I would not trust eating it!
Exactly. The purpose of the lawsuit is to cost you time and money and to destroy you financially.
The Protection of Lawful Commerce in Arms Act was designed to protect gun manufacturers from this sort of action, but the Supreme Court in Connecticut believes they have found a way around it.
In many ways, very similar to the cake case.
Tort lawyers have become one of the enforcement arms of the Left.
The queers all know that going to this one baker will end badly, so why are they going there? They are going there to push the issue that they want him to be forced to accommodate him. What does the media do? They back the homosexuals in their agenda so as to have something to print, disregarding propriety.
More detail. The pervert is a lawyer, and called to order a tranny transition cake the very day the Supreme Court made it’s ruling. Total set up.
No. They back the homosexuals so as to advance their agenda, and destroy Christianity in America. Progressives do not believe in God. They want no limits on government. Nearly all Media is Progressive media in the U.S.A., with the exception of a few conservative outlets.
The leftards say Facebook can ban whoever they wish as they are a privately owned company. Evidently, that doesn’t matter in this case.
The left has declared war on conservatives. A year from now is going to be much worse than it is today. Killing someone who is conservative, wearing a MAGA hat, or having a Trump sticker on their vehicle will be a badge of honor.
An insane man named Scardina filed a frivolous lawsuit against Phillips last Wednesday in District Court for the city and county of Denver, Colorado. Gender confusion is a treatable mental disorder, no matter how many lawyers and Democrats say otherwise.
A person born a biological man remains a man no matter how many hormones he takes, and even if corrupt medical professionals perform sexual reassignment surgery. They remain corrupt and the patient remains insane, more importantly, the patient remains a biological man.
It IS that simple. Ask Ben Carson if you are confused.
