An IT company based in Silicon Valley has filed a lawsuit against the United States government for denying an H-1B visa to an Indian techie.
[ .] The company asserts USCIS acted capriciously when they denied Anisetty the visa stating his position did not meet the criterion that "a baccalaureate or higher degree or its equivalent is normally the minimum requirement for entry into the particular position."
According to Xterra, they had submitted all evidentiary documents as requested which proved that Anisetty's appointment as Business Systems Analyst qualified all four criteria for an H-1B specialty occupation, yet, the USCIS gave no explanation for denying the company's petition for granting a visa. Currently, Anisetty holds valid H-4 dependent status through his wife, the principal beneficiary of an H-1B application. [...]

Really? It absolutely true that once an Indian heads up an engineering department, they massively only hire other Indians. I've been in the Silicon Valley over 20 years, and I can verify that this is not just a saying, but the cold, hard truth.
This even is true if the candidate can be shown to be incompetent during the interview process - they get hired anyways, and I've been asked to clean up their mistakes.
To walk through a US engineering department, and see NOTHING but Indian faces is not just a slap in the face, but a frontal assault - on everything we supposedly hold dear as Americans who bend over backwards to give everyone a fair shake.

I got hired back in 1963 by a heavy machinery builder, and after I was there for a year or 2, they began hiring any Indian who walked through the door. But it was wrong to think all Billion plus Indians are the same. Out of the 5 Indians hired only 2 were good in theoretical work. None had the combination of theory+hands on operating experience+Fortran that I had. Anyways I stayed there 23 years and computerized the heck out of manufacturing and engineering processes. My outfit wiped out the competition and was the premier outfit for delivering multi-million dollar ma Hines to GM, Ford & Chrysler. Until Japan & China took away lot if the business with subsidies by their governments which were absent in United States.
I couldn’t agree more if that is the case. Could it be because Indians are cheaper to hire? Or may be the Indian boss thinks the H1-B people are easier to keep under control. My boss was a Greek and he was extremely controlling. The American engineers in our group all quit. So the boss would only hire Indians. Indians are used to autocratic Indian bosses.
