An IT company based in Silicon Valley has filed a lawsuit against the United States government for denying an H-1B visa to an Indian techie.
[ .] The company asserts USCIS acted capriciously when they denied Anisetty the visa stating his position did not meet the criterion that "a baccalaureate or higher degree or its equivalent is normally the minimum requirement for entry into the particular position."
According to Xterra, they had submitted all evidentiary documents as requested which proved that Anisetty's appointment as Business Systems Analyst qualified all four criteria for an H-1B specialty occupation, yet, the USCIS gave no explanation for denying the company's petition for granting a visa. Currently, Anisetty holds valid H-4 dependent status through his wife, the principal beneficiary of an H-1B application. [...]

The business was expanding. I was a very senior engineer, with a compensation package to match. They were very junior.
It made sense to the boss. And they’re still in business.
The Chinese guy was later fired for watching porn at work, using long distance Japanese dial-up connections. You get what you pay for...
The Indian and the Vietnamese were still there last I checked. I’d drop in every once in a while for a social call, and the Vietnamese guy would disappear (I think he was afraid of me) the Indian was a nice guy in person. He the boss and I would bounce ideas off each other and swap war stories...
Indians are being hired every where...paraphrasing.
That's stating not blaming. Quit playing the race* card.

I blame both. Most of the indians I have worked with had to have knowingly committed fraud of some kind to even claim to be qualified for the job they were hired for. Cheating on tests, ad having other people take tests for you is considered normal in India. They don't see anything at all wrong with it.
And God help a poor American worker who finds himself in a department where an Indian has the ability to hire. He'll be the last one ever even interviewed.
Off topic, but I was looking around a couple of months ago for some good sized graphics of pictures of microprocessors. The ones I had in mind were the ones that look like cityscapes. I wasn't able to really find much of anything except really low-res stuff. Was wondering if you might know where such might be.

Cheating on visa applications is illegal. Prosecute the cheaters! Simple as that. But can’t throw out the honest ones who accept jobs offered LEGALLY to them. That would smell of prejudice.

I feel sympathy for anyone in senior position who gets laid off/fired, only to be replaced by younger/cheaper/foreign workers.
But then I have to remind myself, companies are not in the business of justice or patriotism. It is all about making the most bucks. And many times they make wrong decisions.
Remind yourself it was not personal against you. The same scenario has probably repeated zillion times in other places.

Why do you think I decided to take my chances in United States? When I graduated with a masters degree in engineering way back in 1962, gov’t of India had a guaranteed job for me in any government run corporation of my choice. Government had monopolies in that era of PM Nehru for manufacture of machine tools (my speciality), aircraft manufacturing, steel and Aluminum production, Telephone manufacturing, Cement production, Railroad rolling stock manufacturing, etc.
What I was worried about is prejudice based on your language. There are more than a dozen MAJOR languages in India. I can’t understand on word when traveling in half of India unless they can speak English or Hindi. I was impressed the entire US has one language!
My American bosses showed no prejudice during my 4 decades of jobs, so I think I made the right decision to stay.
Yes, it's just business, nothing personal. I don't fault the boss, or the H-1Bs. In this case the company changed directions, and my skills were not a particularly good match to the new requirements.
There have been several other times I was displaced by H-1Bs (mostly desi) usually under less clear-cut circumstances. Being asked to train my replacement is rather galling.
Still, for whatever reason I LIKE Indians, mostly, I think because we get each other's sense of humor, and there's a certain devil may care madness to their methods.
One of my early bosses was, like you here on a student visa, then bridged to permanent resident and then citizen. The company he built and is still the CEO had $1 Billion in revenue last year.

You were called out as early as #39 by NobleFree for your falsehood, but you kept it going; and you dont have the decency to give up even when you cant defend your lie anymore.
It is understandable you were offended by all the posts that reflect poorly on your Indian compatriots, but it really takes a dishonest and shameless person to intentionally misread peoples comments and to think he/she can just weasel out when challenged.
You are also very clever in feigning support and appearing sincere while you resent and attack peoples comments. Nobody needs your sanctimonious and obviously disingenuous advice after youve already shown your true colors trying to mischaracterize their comments.
Unfortunately for you, instead of helping to change peoples mind about your fellow Indians, you have just confirmed all the negative traits that people have posted about them. You are now Exhibit A proving that:
1. Indians do shoddy work and pass it off as good, thinking no one would follow up on it (like your lame response to me);
2. They are dishonest and will lie and cheat in order to get the visas (like how you distort other peoples comments so you can attack them);
3. They are very clever when it comes to covering for themselves (like how you feign support to cover the fact that you have zero sympathy for those who lost their jobs to H1Bs. But I guess it is nothing compared to those who hide faults in chips to avoid blame, as someone posted earlier)

This is a capitalist country. Businesses can hire whom they choose. Obviously businesses disagree with your judgement of Indians. Keep in mind any discrimination based on age, race, gender or national origin is against the law. I hope you follow that law.
You seem to have missed the point.
Whether it’s letter or phone call, it is impossible for an unemployed college graduate to prove he or she is unemployed because there are too many H1B’s.
I’ve not had much luck with phone calls.
The resumes of H1B’s should be made available for public inspection. That way the citizens could know what they’re missing.
What about H1-Bs evil twin... the OPT? What tax breaks do employers get hiring OPT?
The truth is Trumps wall needs to start at the Airports. Every H1-B and OPT needs to shipped out. Gone.
H1-B visa foreign workers are not always justified.
American Employers are obviously abusing the system.
In my opinion Million+ LEGAL immigrants admitted EVERY YEAR is far worse. Because most are low skilled and low wealth. Majority require gov’t assistance paid by American tax payers.
At least H1-B visa workers pay taxes. Most LEGAL immigrants pay no taxes. I have a relative who sponsored her mother to be admitted as a legal immigrant. Mother was already over 70 age, never worked in US, never paid US taxes, but began receiving social security supplemental checks for life after a waiting period. And she got free Medicaid. And food stamps.
Reforming chain migration system should be top priority.
