Roger Stone asked a judge on Friday to suppress certain evidence in the case against him, claiming that it was improperly obtained.
Stone's lawyers wrote in a filing that because federal prosecutors said they will not need to prove that Russians were behind the hacks of the Democratic National Committee (DNC) or the Democratic Congressional Campaign Committee (DCCC), or that Russian gave hacked materials to WikiLeaks, any search warrants issued asserting that those scenarios took place were approved on an "inadequate basis."
The filing states that the search warrant applications about Stone showed that the FBI initially investigated him for a range of different potential crimes, including unauthorized access of a protected computer, obstruction of justice, wire fraud, attempt and conspiracy to commit wire fraud and violation of a ban on foreign contributions.
"It is clear, however, that the government has relied on the assumptions made by a source outside of the U.S. intelligence community that the Russian State was involved in the hacking and that the data taken from the various servers were given to WikiLeaks," the document reads. "The government cannot prove either since it did not participate in the investigation at the earliest stage."

Exactly. The odds that the Russians did it are (IMHO) quite small. If there was any real evidence obtained by the FBI I can see no reason to keep it secret.
Stone probably has a Freeper for a lawyer. The lawyer may have given Stone a get out of jail free card.

Okay, but we'll need to see the server to prove that it was not the Russians. In fact we have evidence that a campaign staffer copied the files and gave them to Wikileaks. Unfortunately the staffer was killed in a bizarre law enforcement exercise.

Of course I dont believe it. I was being somewhat tongue-in-cheek making fun of how the prosecutors and judges have frequently been VERY unfair to Stone and other Mueller targets.

One must also consider that Stone can prove that the Russians were not responsible for WikiLeaks' acquiring the DNC files. Assange can and will testify (and provide iron-clad proof of same) in court.
This is going to be fun.
They picked on the wrong guys when they decided to target Trump and Stone. They're going to wish they were never born.

Why is everyone getting these delusions of grandeur about Assange testifying? This trial will be over before Assange is even extradited, IF Assange is extradited. Further Assange has promised that he will never reveal his sources. So far that even squeeze girly man Manning into testifying, what make you think they’ll successfully pressure Assange?

When Assange is faced with proving his innocence of acting in concert with Putin's Centralnaya Sluzhba Razvedky (Central Intelligence), or doing hard time, he'll give up Seth Rich (the contact who fed him the emails).
If, that is, he lives that long. Poor Seth sure didn't. Part of why Assange won't mind giving him up.
