California moves to keep Trump off 2020 primary ballot

SACRAMENTO, Calif. — The California Legislature is trying again to force presidential candidates to publicly disclose their tax returns, hoping a new Democratic governor known for his clashes with President Donald Trump won’t block them this time.

The state Senate voted 27-10 on Thursday to require anyone appearing on the state’s presidential primary ballot to publicly release five years’ worth of income tax returns. The proposal is in response to Trump, who bucked 40 years of tradition by refusing to release his tax returns prior to his election in 2016.

California’s presidential primary is scheduled for March 3. If the bill becomes law, Trump could not appear on the state’s primary ballot without filing his tax returns with the California secretary of state.

Why only presidential candidates?

Why not governors, senators, congresspersons, too?

Completely unconstitutional. The only requirements for being president are listed in the Constitution. Not that they follow those with regard to Obama, but you can’t add to those requirements, even if you’re a state government.

This matter by these democrat led states will end up at the USSC. If it is not struck down then there will be chaos on a level never before seen in the US. It could possibly lead to civil war. Luckily I don’t see how the supreme court would let this stand. These states are crapping on the constitution.

It does matter. They’re not doing it because of a principle, they’re doing it because they don’t want anyone to vote for Trump. They have no right to pick who people can vote for with dirty politics.

I don’t see how their stunt of putting only the top two vote getters on a federal office (U.S.Congress) ballot. Has anyone challenged that in the Courts?

While I strongly suspect that this law would quickly be found to be unconstitutional, it is also pretty irrelevant. Since it only applies to the primary election, it would just mean that Trump’s name would not be on the primary ballot. Even if another Republican then “won” California’s primary election, it would have little effect on the Republican nomination since Trump is a shoo-in. Trump would have plenty of votes from other states be selected as the Republican nominee. (Besides, it’s quite likely that Trump would still win California’s primary election as a write-in. This law would gin up a lot of anger among Republicans and probably backfire badly for Democrats.)

States have a fair amount of latitude with primary elections, so it’s not absolutely certain that courts would overturn this law. But when it comes to the November general election, there’s no chance that California could keep the Republican nominee (i.e., Trump) off the ballot. It’s a slam dunk that the Supreme Court would overturn it. Anyway, technically we don’t vote for Presidential candidates, we vote for a slate of Electors who are pledged to each candidate. So there’s really no way that the slate of Electors could be blocked from the general election.

The Communist California Legislature is trying again to force the president to cry "uncle" for them.

Nobody really cares what is on someone's income tax return. Income Tax returns are between the IRS and the person or organization who submitted the returns. It is NOT your business or my business what is in the returns. We simply do not care.

California needs a state level form of the Electoral College to make it more difficult for a few corrupt and densely populated counties to rule the state and run over honest, tax paying, and law abiding citizens.
