A Massachusetts judge has left court in tears after being indicted on obstruction of justice charges for allegedly helping an illegal immigrant evade immigration officials.
Judge Shelley M Richmond Joseph and trial court officer Wesley MacGregor are accused of conspiring to prevent Immigration and Customs Enforcement (ICE) from taking an undocumented immigrant into custody at Newton District Court on April 2, 2018.
Joseph had allegedly ordered the courtroom recording device to be turned off for 52 seconds while she and the defendant Jose Medina-Perez's lawyer had a conversation about getting him out of the courthouse instead of handing him over to an ICE officer, according to the indictment. MacGregor allegedly used his access badge to release Medina-Perez through a rear door.
Joseph was seen crying when she left federal court in Boston Thursday.
According to CBS, Joseph's attorney Tom Hoopes said outside court: 'This prosecution is absolutely political, Shelley Joseph is absolutely innocent.'

Let her cry in prison for a maximum sentence. Make an example of her to warn off other judges.
Crimes committed by agents of the law ought to come with 10x penalty escalators.
ICE issued a statement following Joseph’s indictment:
Todd M. Lyons, acting field office director of ICE’s enforcement and removal operations in Boston, said:
‘The actions of the judge in this incident are a detriment to the rule of law and highly offensive to the law enforcement officers of ICE who swear an oath to uphold our nation’s immigration laws.
‘In order for our criminal justice system to work fairly for all people, it must be protected against judicial officials who would seek to replace the implementation of our laws with their own ideological views or politically-driven agenda. I would also like to thank U.S. Attorney Lelling for his local leadership and his continuous and faithful support of the ERO law enforcement mission.’
Lefty tears. Lefty has broken the law without consequences for a decade or more. When the real world consequences hit, the tears shall flow.
Thank God, Trump was elected.
Arrogant judge cries when she learns that she is NOT above the law.
The money point made: "...Noonan, along with the rest of the people that Ive listed here still cannot understand, ( or will not admit they understand) Trump was not the cause of their demise but the result of it. The American voter long since has declared establishment Washington dead..."
There are many on both the Left and Right who want the "declared establishment Washington dead", but there is where any common ground ends.
Many on the Left want it dead so they can replace it with a bureaucracy composed of their own Leftist apparatchiks.
We on the Right want it dead so we can return to a form of governance that is closer to the spirit of The Republic and The Constitution, and further removed from a government of graft, corruption, and the will of politicians bent on limiting our freedom.
....the illegal she helped.. Medina Perez was a drug trafficker/dealer selling cocaine and opiates in a state that is among the top ten in per capita opioid deaths.
Where were her tears for all the kids the illegal sold drugs to that ruined their life!
Irrelevant per the Supremacy Clause.
It’s all he can do. It’s like the left screaming “racist” or “Nazi” all the time when they have nothing. He knows he’s lost before he started so he screams “Political”
That is an interesting observation.
When that feminine compassion is wrongly harnessed towards criminals, it has the opposite effect that it would when channeled towards those deserving of it.
Criminals see compassion of any kind as weakness, and it invites more criminality.
That makes the direction of that compassion by a Judge in a legal system meant to UPHOLD the law of the Republic all the more distressing and troubling.
The Globe obtained a recording of this:
Minutes into the Newton District Court hearing for Jose Medina-Perez, his defense attorney asked the judge if he could approach the bench for a quick chat.
There, in hushed tones and whispers, the attorney walked through his client’s predicament with District Judge Shelley M. Joseph and a state prosecutor. They debated what to do with the defendant, who was in immediate danger of being deported.
Medina-Perez, picked up by Newton police on drug charges, faced a fugitive warrant for drunken driving in Pennsylvania and a detainer from US Immigration and Customs Enforcement, according to a courtroom audio recording of the bench conference. In fact, an ICE agent was in the courthouse, waiting to detain Perez and start the deportation process.
“ICE is going to get him,” the judge told the attorneys during the April 2 sidebar conversation. “What if we continue [the case]?” she suggested, before instructing a clerk to turn off the courtroom’s audio recorder. Whatever was said during the next 58 seconds went unrecorded.
Minutes later, Medina-Perez was escorted downstairs, released from custody, and allowed out a back door, according to two people briefed on the episode. He scaled a fence and took off, leaving the immigration agent behind, the people said.
Agreed, but I think she will no longer be a judge anymore, and that is good.
But given that she is a judge in Newton, Massachusetts (and I know this being a resident of that state) which is a wholly Leftist town, just a tad below Berkeley, Madison, Ithaca, and Cambridge, another completely Leftist judge will occupy that seat.
But...we are unlikely to see a judge and law officer operating together like this to allow a criminal to flee. They will pursue the more traditional avenues to allow them to flee.
But it is at least a start.
A conviction and possible incarceration of a judge if it happens might well change more than a few minds about the wisdom of obstructing the enforcement of immigration laws they disagree with. Likely at this juncture they’re watching this case closely.
Yes. We know we are in deep trouble when the very people we entrust to fairly apply the law break those laws themselves. It is the undoing of all jurisprudence.
They should hang her.
Mayor of Oakland? How about the Mayor of Baltimore, Catherine Pugh, not lucid enough to resign? That story is just as bizarre as this.
Reading that account is astonishing, and creates an enormous amount of anger in normal, law-abiding citizens.
Just wow.
We all understand what they go through to use pretzel logic to twist and distort the legal system to let scum like this walk free, and we despise that.
But this level of bold chicanery in direct view of people establishes a new standard of legal malpractice.
Yes. It's also how Muslims see it, btw.
You’d have to think that every attorney who had a client found guilty by this judge is preparing an appeal.
I would not agree with hanging her, though like you, I see the danger in allowing this to resolve without serious punishment administered due to her abdication of her oath as a judge and the role of a judge in our Republic.
That said, I do believe there are people who should be hanged for various crimes, and some of them are involved in the coup attempt against our President.
But at the very least, this woman should not only be completely removed from any legal function now and in the future, and should serve jail time and pay fines.
That is recorded criminal conspiracy to obstruct justice right there. Not sure how she thinks she is going to get out of being prosecuted successfully for this, though I have no doubt she and her numerous allies think she will weasel out of it.
Here is a case that demonstrates how meaningful the rule of law is in this country.
