The police were called about an armed man in the Park. It is NOT illegal to carry a pistol in Neinhuis Park. Hubbard reportedly was carrying an AR15 type pistol, which may look like a rifle to people who are not knowledgeable about firearms. It was slung over his back. It is currently illegal to carry a rifle openly in the park, but will become legal as of 1 November, 2019.
Broken Arrow police are defending the arrest of a Second Amendment activist in the face of accusations that officers overreacted and violated the mans rights.
Police arrested Richard Hubbard, 37, at Neinhuis Park off Lynn Lane Road near 51st Street on Monday evening, according to a news release. The department reportedly had received several calls about an armed person, later identified as Hubbard, in the park.
Officers eventually used a pepperball launcher on Hubbard after he reportedly ignored commands from officers. Officers then arrested him on complaints of felony pointing of a firearm and obstruction. He was later posted a $15,500 bond and was released.

And them wait 5 years to get some of them back. The cops in this case are just pawns of the elites. they are supposed to know the law, and the judge should too, which doesn’t include confiscation of his firearms. These actions make people hate the authorities, cops and Judges.
You have no idea how many people I’ve spoken with over the past few months who have completely changed their opinion of the State police and County Sherrif’s Deputies. They’re now all late 20’s/early 30’s, rigged out for battle and, in the opinion of the 50-something military vets among us, itching to kill someone.
The real criminals, drug-dealing gang-bangers from NYC and Philly, get a slap on the wrist. Things best change, and quick, or they’ll find themselves with no allies in the areas they patrol.
As a 50-something military vet I unhappily but fully and completely agree.
It’s certainly not something any of us ever thought would happen, and it’s painful because many of us knew these kids when they were young. Now they don’t hesitate to pull weapons on us, detain us for a blood test when we blow a 0.0 on the DUI test, trespass on private property for no reason and refuse to leave when confronted. We’re still trying to figure out what happened to them, and when did we become their enemy?
An April 11th news article...Has Hubbard released a video? No updates yet?
I have neighbors who’d have to pay nearly $5k/day at that rate.
I am somewhat familiar with these “auditor” guys. They will tell you that their goal is to protect the First and Second Amendments. In most cases, that is simply not true.
Their goal is to provoke. Provoke the police. Provoke security guards. Provoke the general public. Then they video the chaos that follows, and put it on YouTube. They get paid per view. More chaos means more views.
The guy in this story does exactly that. His YouTube name is ‘Picture Perfect’. My previous posts will show that I’m no fan of the police. Not at all.
But I’m also no fan of bums like this guy. He is just creating chaos for his own personal benefit.
An April 11th news article...Has Hubbard released a video? No updates yet?The police confiscated his phone, which he was recording the incident with.
There is considerable push-back from the gun community. A march is planned for 1 June. No charges from the District Attorney, as far as I have been able to determine.
Popular speech needs no protection.
The First Amendment is for controversial speech.
The Second Amendment protects the First.
He wasn’t livestreaming it?? Well if he’s going to be a provocateur, he should invest in some livestream technology.
Don't mess with the old guys, kiddies... ;-)
You have to be uploading live to the Internet, apparently.
Regardless of livestreaming, a lot of phones instantly upload to the cloud and downstream the content to the user's other devices, making confiscation of a phone irrelevant to a person keeping content for personal use later. Take my phone, the content is already streamed to my home computers and shared to certain relatives. Good evidence to use against abusive cops in court.
I am not in my late 20's/early 30's, but something has got to give in this country. The end result is not going to be pretty.
Surrender all of his firearms? Why? That makes absolutely NO SENSE.
This should be a single, quick hearing...is this a rifle? No, your Honor. According to the BATFE, this is a PISTOL, which is legal to OPEN CARRY in this park.
GAVEL. Case dismissed.
This bullshit of surrendering all his firearms is judicial overreach, at minimum.
Should you wish to learn a little more about him and this event, I suggest reading a bit at the OK2A (Oklahoma Second Amendment Association) Discussion Group. You may have to poke around some as this is an active Facebook page.
You might find out that your knee-jerk reactions and uninformed assumptions were inaccurate. You might also find out that the initial complainant changed her story, that somehow the alleged perpetrator's cell phone has come up missing, and that BA officers conveniently did not have any vest cam footage.
Having grown up in BA, this sounds both pretty damn fishy and par for the course. Of course, your mileage may vary, but I hope you'll do some honest research and reconsider your opinion.
When lawful behavior creates chaos, it is people like you who are chaotic.
I am in no way defending the police in this particular case. But I won’t let the “auditor” off the hook either.
Consider how folks in an open-carry state typically exercise their 2A rights. They’ll attach a .38 or a 9mm pistol to their belt, then go about their business.
But that’s not what this Hubbard guy did. He went to a park where open-carry of a pistol is allowed, but open-carry of a rifle is not allowed. Did he choose to carry a typical pistol? No. He chose to carry a pistol that somewhat resembled a rifle. And he slung it over his back like you would a rifle. He represented that he had a rifle.
Hubbard had every legal right to do this, of course. I do not question that right. What I do question is why he chose to do what he did.
I’ve seen his YouTube videos. His goal, in my opinion, is not to exercise his rights. His goal is to provoke an angry response. Confrontational videos get a lot of views. Views = money.
If he wants to do that, fine. But he’ll get no respect from me. I think he’s pulling a con on true 2A supporters.
I do understand that some folks will see this differently.
So if they drop the charges I'm sure he'll get all of his firearms back the same day or the next. Just kidding.
