Illinois Senate to Trump: No tax return, no spot on ballot

Donald Trump will have to release five years of tax returns if he wants appear on the Illinois 2020 presidential ballot, the state’s senate has ruled.

The bill, which still requires approval by the Prairie State’s House of Representatives, comes amid a growing row in Washington over Mr Trump’s unprecedented refusal to make publicly available his income tax returns.

The US Treasury ignored a congressional deadline to release the documents earlier this week. Treasury secretary Steve Mnuchin claimed the request by the House ways and means committee was “politically motivated”.

Mr Trump himself has claimed that he cannot release his tax returns because they are under audit, although technically there is nothing preventing him from doing so.

Short-sighted Dims.....

Apparently, they haven't thought through the fact that any Democratic candidate will also have to release their tax returns in order to appear as a presidential candidate on their ballot.

Bill of Attainder. If they pass this they should all face prison time.

I really think the idea that elections are deciding anything is past. I think there’s only way out now. Trump is a great reprieve, but only delaying it.

"Unprecedented"? It only became "precedented" with Nixon (and a fat lot of good that did!)

I don't think that this would pass Constitutional muster. States haven't even been able to pass term limits, because that has been declared unconstitutional. They would need a Constitutional Amendment, the chances of that happening before 2020 are 0.

We have not seen the law as written.

However the Constitution takes a dim view of laws that are written to apply only to one person.

I suspect that to make the law constitutional that the law would need to require each and every candidate running to divulge his/her tax returns.

Since a problem with a tax return would or could prevent a candidate who won the primary from taking office, it would be necessary to have all candidates in both primaries divulge their tax information.

See where this would go?

There are obviously primary candidates who would never want their information disclosed. And most of them are dims.

As usual, dims are just that; dim.

I cannot make up anything in his tax returns that would interest me in the least. I dont care about his charitable donations. I dont care about his gross or net income. There is nothing there illegal. I dont care about his multiple corporations income or foreign profits. There is no there there. What are the looking for?

Note that each state gets only one vote. Reps don’t vote individually.

So what would stop any state from developing its own criteria for deciding who can be on the Presidential ballot? What about the VP?

This is unconstitutional.

This is Trump trolling them once again; and every time, they fall for it.

There’s nothing in those tax returns of note. Like most large organizations; especially organizations which have been as high-profile as Trump’s; there are IRS auditors present 12 months per year, every year.

I do this for a living, and Fortune 500 companies in fact have offices set aside just for auditors; financial, IRS, Sales Tax, and otherwise, at their headquarters wherever the accounting records are available. I would guess the Trump Organization companies have similar accommodations.

The auditors are there so frequently; the corporate staff know them by name and share the coffee pot in the lunchroom.

Trump’s personal returns are also eternally under audit since he is/has been an officer of all of the Trump organization companies; an audit of the personal returns of the named corporate officers is required when a corporation is being audited.

My guess is that these returns are some of the cleanest returns out there. Are there audit adjustments? - Sure. The tax auditors aren’t allowed to finish the audit without an adjustment. 95%+ IRS audit adjustments are technical or computational in nature and there is zero indication of fraud.

Trump will hold out to the bitter end on releasing the returns; and if there ever are returns released, there will be no “there” there. Count on it.

Imagine if every state starts creating requirements aimed at the opposition party. Dangerous stuff.

How about if you destroyed 30,000 emails while in government service and fail to produce them? Or if you own a private foundation you must let state regulators investigate it?

Ultimately banning the opposition party will lead to civil war and dictatorship.
