Sharp Grossmont Hospital secretly video recorded 1,800 patients using hidden cameras at the women's health center in El Cajon, according to a lawsuit filed late Friday afternoon.
The recordings took place between July 17, 2012 and June 30, 2013 inside three Labor and Delivery operating rooms at the facility located at 5555 Grossmont Center Dr. in El Cajon, the plaintiffs claim.
Among the video recordings captured by hidden cameras: Caesarean births, hysterectomies, sterilizations, dilatation and curettage to resolve miscarriages, and other procedures, according to court documents.
Women were also recorded undressing, the lawsuit says.
According to court documents, the hospital claims the recordings were part of an investigation "into whether an employee was stealing the anesthesia drug propofol from drug carts in the operating rooms."
The suit states that the motion-activated cameras were installed on drug carts in each of the three operating rooms at the women's health center, but the cameras continued to record after motion stopped.
Because of the angle and placement of the devices, the suit says "patients' faces were recorded, and the patients were identifiable."
At times, Defendants patients had their most sensitive genital areas visible, the lawsuit states.
Multiple users, including non-medical personnel and strangers, had access to the recordings on desktop computers, the lawsuit claims, and that Sharp did not log or track who accessed the recordings, why, or when."

The hospital might as well close up shop tomorrow. Theyre done. The HIPPA fines alone will bankrupt them.

From Wikipedia - Sharp (which leases the facility from a governmental entity and operates it) is a non profit with Revenues of $3.5 Billion. Looks like a pretty deep pocket.
Although they may have enough money to spread around to buy the friends they will need.

Im no expert on the finer points of the law but weve done IT work for several medical concerns and their people take patient privacy deadly serious. Even the smallest infractions can bring really, really big fines.
This will set them back millions on that front alone. The lawsuits are another matter entirely.

I believe it was Kaiser in California that was fined a million or so when one of their employees took a thumb drive with patient info home to do some work.
They have no sense of humor about it at all.
And if it were my wife or daughter this happened to Id sue the living snot out of them.

No loophole would cover this mess.
Each person would have had to sign forms granting the hospital permission to film them. And I would imagine it each recording would require a completely separate signature.
This doesn’t even cover the perverts that most likely downloaded parts of the filming.

I found it curious that one obvious procedure was omitted. (Maybe abortions aren't done at this clinic).
The other sections I highlighted involved the issue of recording.
And if you noticed, I didn't include abortion in the key word search because it wasn't my only takeaway.

Yeah, that’s the ticket! Here we are with a shortage of hospitals (and it’s critical in SoCal because of the illegals getting “free” medical care), and the first think everyone wants to do is launch a bunch of senseless lawsuits which will, as you point out, likely cause them to have to close their doors. Instead, they should punish the idiots that thought that this was a good idea. Pogo is at it again!
Apparently Grossmont still owns the physical facility, but has leased it to Sharp and has an operating agreement with them. So worse case scenario Grossmont ends up with the facility back and either operates it itself, or enters a deal with another operator.
