It’s a fundamental power, laid out in the Fifth Amendment. The government can take your land to build public works... The federal government rarely loses its bid to take land. Under a special procedure, federal officials can file a Declaration of Taking that results in a court granting immediate title to the land. Bulldozers can roll the next day. The only fight, essentially, is over how much money the property owner will receive.

For the more than 1,200 miles of the Texas border with Mexico however, the border itself is in the middle of the river.

The Kentucky/Indiana border was the northern bank of the Ohio when the line was drawn. Decades of floods have moved the Ohio's northern shore, but the legal line remains.

Sr Airman Triple Amputee Brian Kolfage has been doing just that raising money for a Private built wall, with either buying land or donation of land. Update and President Trump supports the Effort. Why hasn’t the amount grown from FReeper contributions. I’ve made 5 on a SS Income. Speaking for myself (but I believe these considerations affected the overall fudraiding), I refrained from contributing because I did not consider it a realistic, feasible solution.

1. Historically, private contribution efforts for border barrier have resulted in minuscule amounts of money, compared to the cost - they raise hundreds of thousands, or a few million dollars, while the cost is many billions. This GoFundMe effort was the most successful, raising about $20 million - just the cost of one mile in the Rio Grande Valley, or about five in the flat desert, of the type of barrier that Border Patrol thinks is needed. You could install a lot more of chain link or other common fencing, but they would cut through or climbed over easily.

2. Legally, we can’t make the Government spend the money on what we want. Contributions can only go into the general treasury account, unless Congress specifically authorizes contributions to be used for a specific purpose (like building the Washington Monument, or repairing the Statue of Liberty). Congress has not, and likely will not, authorize contributions for a border wall.

3. Private builds would probably not be compatible with Border Patrol operations and maintenance. After it is built, barrier has be maintained and policed effectively. Border patrol would likely have to do that. They design their barrier for their operational requirements (some of the features are secret), and develop a logistical system tailored to maintain just that. It would likely not integrate well into a consolidated defense.

AFAIK any time gov’t takes property/land from private owners under eminent domain, the owners are always compensated fair market value.
