Background checks face repeal effort (NM citizens prepare to fight back(
The Albuquerque Journal ^ | March 7, 2019 | Dan Boyd

SANTA FE – Top House Republicans said Thursday that they are aiming to repeal a high-profile New Mexico gun background check bill via a rarely used voter referendum process.

But House Speaker Brian Egolf, D-Santa Fe, said the effort to annul the legislation would be legally dubious and ultimately futile.

But the measure, Senate Bill 8, has generated broad opposition from all but a few of the state’s 33 county sheriffs. In addition, 25 counties have passed “Second Amendment sanctuary” ordinances in opposition to gun-related bills pending at the Roundhouse.

Although the state’s three most populous counties – Bernalillo, Doña Ana and Santa Fe – have not joined the movement, top-ranking House GOP lawmakers said the outcry shows lawmakers have ignored the will of New Mexicans, especially those in rural parts of the state.

“It appears that what we’ve done is pass a law … that the citizenry is not behind,” House Minority Whip Rod Montoya, R-Farmington, told the Journal. “This level of response requires that we take action.”

Per the state Constitution, backers of the effort would have to obtain valid signatures from more than 70,000 state voters – or at least 10 percent of those who voted in last year’s general election. There is also a geographic requirement that a certain amount of the signatures come from at least 25 counties.

If those thresholds are met, it would compel Secretary of State Maggie Toulouse Oliver to put the question of whether to accept or reject the law on the next general election ballot – likely in November 2020.

However, Egolf pointed out that bills dealing with spending and public “peace, health or safety” are exempt from repeal under the constitutional referendum process. He said the bill to expand background check requirements would meet that definition.

A spokesman for Lujan Grisham, the state’s first-term radical left-wing Democratic governor, insists the background check measure is “not an anti-Second Amendment Bill” saying "why are House Republicans so desperately afraid of simple, non-invasive, easily obtainable background checks that will reduce lethal violence in our communities?"

Duh - the Rats just don't get it, or they do but it's part of their anti-Constitutional effort to take away our freedoms so they can take and keep power.

The Left still uses the background check smokescreen. Criminals are not in the habit of obtaining their firearms from legal sources. The people who drafted this legislation know that, but are willing to ignore that reality in an effort to establish the foundation for a registry.

NM is turning into a blue state hellhole, as the demonkkkRAT leftists, socialists, commies, marxists, anarchists, eco-scumbags etc continue their infiltration and takeover of local and state gov’ts. Just like the muslims (SPIT!) are doing.

So many states - PA, VA, TX etc - are slowly changing from red to blue.

America will not be the same America in 15-20yrs.

Plenty of evidence to show background checks DON’T work and thus, have no bearing on safety.

Sadly, I think you timeline is wrong.

5-10 years at most.. If a rat gets in after Trump’s second term, or they get the senate too..

it’s over..

Our only hope would be enough states call a article 5.. but I far to many states will have gone rat by then.

It’ll be time to open the ammo box if that fails.

You are exactly right. Too many on our side are too complacent and have a false sense of security with DJT in the White House. After DJT leaves, look out.

They feign innocence and naivety.

Dems are liars through and through.

That kind of technique is a very typical manipulation technique to try to get people to make them look bad, and feel bad,and back down.

And it’s worked in the past.

They have been exposed and they can deny it all they want, but we are NOT reading the situation wrong. We are right in what they are trying to do and they are lying to try to pretend that they are innocence and just want what’s best for everyone.

No more.

Sadly, I think you’re right. If we lose the WH or Senate, or both in 2020, we’re all but done, in a LOT of ways.
