Mollie Tibbetts’ accused killer wants trial moved to different county due to 'minority population'

An illegal immigrant charged in the murder of Mollie Tibbetts, a University of Iowa student found dead in August, requested his trial to be moved to a more diverse county in the state so his jury pool has more minority representation.

Cristhian Bahena Rivera’s attorneys filed the motion Friday, arguing that existing tensions and opinions in Poweshiek County — which is the area where the crime occurred, Tibbetts grew up and Rivera lived and worked at a dairy farm — will make it hard to have a “fair and impartial trial,” the Des Moines Register reported. The attorneys asked the court to select a county that has more of a minority representation for the jury pool.

"Without venue where a minority population is substantially represented, [Rivera] cannot be fairly tried and any jury pool chosen will have to be stricken," the motion reads.

The trial is set to begin on Sept. 3, Des Moines Register reported.

Rivera, 24, pleaded not guilty to murder charges in September, about a month after he was arrested and Tibbetts’ body was located in a cornfield about 12 miles southeast of Brooklyn. The 20-year-old college student vanished on July 18 while going for a jog in her hometown.

Tibbetts’ parents have been vocal in speaking out against linking his daughter's death to the illegal immigration issue.

In September, Mollie’s father, Rob Tibbetts, wrote an op-ed for the Des Moines Register that his daughter would have “vehemently opposed” anti-immigration views and asked politicians to not use her death to “promote various political agendas.”

Her mother, Laura Calderwood, also took in the teenage son of Mexican immigrants who worked with Rivera prior to his arrest.

It isn’t anti-immigration, it’s anti-illegal.

There are so many corrupt and dishonest people who keep getting this wrong intentionally.

That man should be utterly ashamed to side with his daughter’s killer. I don’t know how he can show his face in town.

Blackhawk Co. has about the same demographics as Polk Co.

Juries are drawn from counties, not from inside city limits.

It’s Iowa. There are no diverse counties, unless they mean Scandinavians versus Germans.

Dude, you are talking 1985 Iowa. There are now several counties in Iowa that are 25% Hispanic or more due to them coming to work in the ag industry (beef and pork packing plants, egg/chicken places)

And whether you like it or not, you can thank wealthy Republican farm interests that are making it happen.

I blame the Democrats for screwing up the labor markets with endless regulations that increase the cost of labor, and the big biz open borders republicans who go along with hiring illegals and cheap labor express.

Plenty of blame to go around.

The crime is not a personal wrong against the daughter. For that, the father can file a wrongful death civil action on behalf of her estate. The criminal trial will be in the case of “The People of Iowa vs. {fill in name of dirtbag here}” which is the father’s first clue that this is not his personal grievance.

Well, lets see. There’s plenty of his peers working on the dairy he worked at. Also, Mollie’s mama moved one of his illegal relatives into her old room so there’s another one. Have her liberal daddy claim his residence there and there’s both her parents and her brothers who could also serve on the jury who’d be on his side. His illegal ex gf is a bit wishy washy but if she’s thinking of ever getting child support from him for their anchor baby, then she’s another jury member.
