Supreme Court appears inclined to let 40-foot ‘Peace Cross’ stand on public land

A majority of Supreme Court justices offered tepid support Wednesday for letting a Maryland war memorial in the shape of Christian cross remain on government land, in a landmark First Amendment case with implications for religious symbols on public property across the country.

In a spirited 70 minutes of oral arguments, most justices appeared to accept the narrow, limited view that the monument was historically significant and its Latin cross design reflected the nationwide trend at the time it was erected to honor war dead with community memorials.

"What message does that send when people see that on TV, they see crosses all over the country being knocked down?" Justice Samuel Alito asked.

The justices seemed to default to their previous approach of resolving such Establishment Clause appeals on a case-by-case basis, signaling they may avoid a broad ruling that would provide clear markers for similar legal disputes in the future.

The case is one of the most closely watched this term. Newest Justice Brett Kavanaugh asked tough questions of both sides, but gave no indication of how he would vote.

The Bladensburg Peace Cross, as it is known, sits in a traffic circle in the Washington suburbs, where it has stood for nearly a century to honor 49 local World War I soldiers who died in battle overseas.

Its supporters, including the Trump administration, say the 40-foot monument was created solely to honor those heroes and is secular in nature. Opponents call it an impermissible overlap of church and state, since it is controlled and cared for by a Maryland parks commission.

Arguments over WW1 cross showcase stark religious divide at Supreme Court, and possible split between Trump's two justices

This is the first reporting I've seen that indicates that Ruth Ginsberg is back in court hearing arguments. I guess all the people speculating that she was too sick to ever appear in public again were wrong.

Or: kooky conspiracy theories that the RBG today was a body double, etc.

As far as I know there’s nothing stopping say, Jewish or Muslim veterans groups in this or any other memorial, to be fair, from putting up their own symbols. But they would still argue that it violates the separation of Church, any Church(s), and State. This arguement is intentionally misleading citing the “establishment clause” while ignoring the equally important second half of the sentence that recognizes the “free exercise of religion” that negates their arguement. Christian crosses do not establish a state sponsored religion that prevents the free exercise of other religions in America.

The Supreme Court may have gotten the message that if you keep knocking down our peace crosses, you might get war.

One can only hope, not that SCOTUS gets the message, but that we would have a war if they keep knocking down crosses and attempting to remove Christ from our country.

Zero from WWI. The first Mosque in America was built in 1934. And I cannot find the name of a single moslem American soldier who died in WWII.

Went to the American Cemetery in Normandy. Saw a lot of Crosses and Stars of David, but no Crescents.

The murmur they may have heard and heeded is that if the SCOTUS keeps pandering to the anti-Constitutionalists in their interps then there’s no longer any reason have a SCOTUS.

And if it’s gonna be the loudest crybullies win the contests, we’ll bring out our guns and make *all* the noise.

How many Muslim war dead did this country have from World War I????? Any?????

I found two different articles that said roughly 5,000 Muslims served in the American armed forces in WW1. Given that almost 5 million Americans served in WW1, a figure of roughly 0.1% seems reasonable.

Surely some of those 5,000 men were killed in action.
