President Trump has a pool of roughly $21 billion in military construction funds he can use to build the border wall by emergency declaration, congressional aides said Thursday — though much of that is already destined for other projects that would have to be put on hold.
The White House said Thursday that the president will follow through on his threat to declare an emergency and use the Pentagon to build fencing, going around a Congress that just denied him most of the money he had sought.
“President Trump will sign the government funding bill, and as he has stated before, he will also take other executive action — including a national emergency — to ensure we stop the national security and humanitarian crisis at the border,” said White House press secretary Sarah Huckabee Sanders.
Details on the plans were scarce, though. It wasn’t clear how much money he would need, where he would build the wall, whether he will use new designs, or whether he’ll be able to overcome private property and environmental hurdles.
Mr. Trump also will face myriad lawsuits, and will also have to survive an attempt by Congress to overturn his emergency declaration.
“Make no mistake — Congress will defend our constitutional authorities in every way that we can,” said Senate Minority Leader Charles E. Schumer.
The president had teased an emergency declaration for months, though he said he’d rather have Congress cooperate on trying to find a funding agreement.
Instead Congress, in a new deal this week, gave him only about a quarter of the money he asked for — and added insult to injury by placing numerous restrictions on where he can build, what he can build, and when he can build.
His emergency powers could circumvent all of that.

I think Trump genuinely doesn't want to see another government shutdown and people not getting paid.
Won’t they just file their legal challenges whenever he starts to take action?
No other military construction project is as important as protection our nation from the current invasion.
Hopefully Trump has his people read the bill. Because there is fear the Democrats may have slipped something in there that takes away his emergency powers on this.

I don’t blame him for not wanting a second shut down.
During the first one, very few GOP found a way to open their RINO mouths and defend the president’s decision, or explain why it was the right thing to do. Most the GOP is still unused to calling out and pushing back hard against the Lib-BS.

People not getting paid? Maybe they should find a job in the private sector. I don’t have much sympathy for people getting paid for not working even if it is after the fact. After all — everyone has enough money in short-term savings to last a year without a paycheck, right? If not ... just damn.
The government doesn’t have to shut down if trump walks from this deal. He can tell Mitch and the other RINOs responsible for this monstrosity to put together a continuing resolution maintaining spending at current levels. At least he won’t be signing into law these outrageous provisions and giving government workers and contractors raises after being off with a five week paid vacation. This deal is outrageous and I feel very let down by this party again but also Trump.
Take it from Afghanistan. Dare Congress to strip away border money and give it to the ragheads for THEIR security.
He was quoted earlier saying “my team is looking for the land mines” or something very similar.

As Mark Thiessen has pointed out, Obama’s sequester exemption will expire at the end of this year and Trump could hold that over their heads. You feel lucky, Chucky?
