Sunday on NBCs Meet the Press, Sen. Marco Rubio (R-FL) said President Donald Trump declaring a national emergency to build a wall on the U.S. Mexico border would be a terrible idea and that he would fight it.
RUBIO: Sure. Because I think its important. Look I dont think we will have to fight. Im not sure they will do that. I know its an option they looked at. But now you are at the mercy of a district court and ultimately an appellate court. It may not withstand if you look at some of the other rulings we have seen. The other is the precedent it would set. Its not a good precedent to set. It doesnt mean I dont want border security. I do. I think thats the wrong way to achieve it. It doesnt provide certainty. You could wind up in a theatric victory at the front and not get it done. The best way to do it is to have a law that funds border security so we know its going to happen.

Under the National Emergencies Act, Congress by veto proof majority can override a Presidential declaration of National Emergency. The court, has no place in the process. Re. nationalizing industries, that I believe would be a different situation as it would be essentially stealing from the owners which has no basis under the Constitution. Again, this is a separation of powers issue and Congress is the authority to override the President in this situation, not the courts and especially not a circuit court trying to create national law.

Was trying to be succinct and expected you would understand - but if Trump doesn't cave it most certainly will be up for a vote.
We should expect the House will continue with impeachment if Trump continues with the wall. The question of whether he remains in office will turn on the votes thereafter to Convict in the Senate by a) Senate Democrats, b) the Senate Rino's and c) Senate R's that might go wobbly at the last minute after assuring him they had his back.
What's worse, if the socialist dems think they already have the votes, they may not even bother going to court.
As it is now, he goes to bed every night wondering whether they will throw him out of office for providing adequate national security.

The House will push toward impeachment whether Trump caves in to their will, or not. His very existence is a cause for constant angst and anger to them. The wall is only an incidental justification for their hatred of the man.
Cutting to the chase, Congress will push a detonator switch on this country if they impeach him. That, you can depend on.
The courts will do the same thing if they try to prevent him from exercising his authority to declare a state of emergency.
Don't change the subject, whiner.
