President George W. Bush flexed the National Emergencies Act in the days after the 2001 terrorist attacks, President Jimmy Carter used it during the Iranian hostage crisis, and President Barack Obama tapped it to handle the swine flu pandemic in 2009.
Now its President Trump who is eyeing the 1976 law, figuring it could be his ticket out of the shutdown showdown, allowing him to build his promised border wall without needing to get Congress to specifically approve the money.
The White House said no decision had been made in the run-up to Mr. Trumps Tuesday night speech on border security, but the president was clearly eyeing the powers as a viable escape route.
Congressional Democrats and liberal activists warned of a constitutional crisis and promised they would fight any emergency declaration in the courts and in the halls of Capitol Hill.
Political analysts said Democrats would struggle to muster the votes to stop Mr. Trump in Congress, and legal analysts said they also would be hard-pressed to win with judges.
At the end of the day, the law allows him to declare what a national emergency is, said William Cowden, a former assistant U.S. attorney in Washington, D.C. Whether the wall eventually gets built or not, it gives him an out to go back in and reopen government.
Even the Democratic chairman of the House Armed Services Committee said over the weekend that the law appears to give the president emergency powers.

Round 3 Trump gives 2nd oval office address declaring he has no choice but to delare a national emergeny to protect american women and children the dems will not.

This is a problem caused by congress and trump was put in office to fix it. The shutdown is the last card to play because we all know it’s now or never. Trump should also use the debt ceiling this way if the shutdown runs this long.
Per the speech I liked the line about wall’s not about hating those on the outside but loving those in the inside. A general concept I’ve always whipped out on the commies about locking the door on your house - keeping folks out or locking your family in.

Well, the Feds have to protect the right of Californians to.a republican form of government, Im not sure they have that now.
Something drastic is going to happen in the not too distant future of CA due to the leadership being put in office by the majority of residents and notice I didn’t say citizens.
It sickens me because that’s my native state that I was born in and spent over half my life in, I clearly remember what a great place it used to be.
