One reason gerrymandering has been such a contentious issue over the years is that the Constitution has very little to say about House representation beyond the details for apportioning House members among the states. The Constitution didn't even provide for Congressional districts at all -- just a set number of House members for each state, based on population. Some states used to elect some or all of their representatives on a statewide basis.

Yes, it was supposed to be up to the legislative power of each state . . . not judges.
