A spokesperson from the Centers for Medicare & Medicaid Services told Fox News early Saturday that open enrollment for Affordable Care Acts health insurance will continue despite the federal judge's ruling that the law is unconstitutional and must be "invalidated in whole.
U.S. District Judge Reed O'Connor, a federal judge in Texas appointed by President George W. Bush, ruled that last year's tax cut bill knocked the constitutional foundation from under Obamacare by eliminating a penalty for not having coverage. The rest of the law cannot be separated from that provision and is therefore invalid, he wrote.
The decision came on the evening before the Dec. 15 deadline for Americans.
The spokesperson from CMS told Fox that the judges decision, which was applauded by President Trump, is still working its way through the courts and is not the final word on the matter.
"There is no impact to current coverage or coverage in a 2019 plan," the spokesperson said.

Only Trump has to immediately follow judges’ orders. Anyone else can basically do what they want
All this sets up is a Supreme Court hearing and their agreement....then you have the Nancy Pelosi ‘period’ to fix the issue. Considering the make-up of the Senate and President Trump...I’d say no repair will occur in 2019, and the health insurance apparatus will dissolve at the end of 2019. The entire primary season of 2020? All revolving around the ‘fix’ or resolution.
Trump should close it down and shutter every department tomorrow
The rule of law only applies to the little people.
Why doesn’t the spokesperson from CMS have a name? Lock him up!
Yup. People need to be arrested.
Dont get me wrong, I think the whole concept of Obozocare is unconstitutional because it forces people to buy something whether they want to or not, but I dont understand how eliminating the tax makes it unconstitutional. Unsustainable? Sure.
Im no legal or constitutional scholar, so Im afraid I just dont get it.
Because it’s going to be appealed.
really>
why is it that when Trump’s administration makes a ruling the courts stop it and they comply with the courts.
But when the conservative courts make a ruling, the leftists ignore it.
The exchanges may still exist, but they shall no longer have access to the original sources of funding for those applications that depend on subsidies for the applicant who falls into the class defined as eligible for assistance..
Otherwise, people now have the option to decline to carry coverage at all, without penalty from IRS, or they can still buy the “insurance” with its enormous deductibles and the right to carry a card, which they find is virtually useless in covering a good many of the ills with which they may find themselves afflicted, ending up paying out-of-pocket until they have spent themselves into penury.
That is a much more fiscally sound policy for just about everybody but the victim, er, Obamacare client.
We're supposed to be the side that thinks with our brains and not our emotions....
I keep getting calls in Spanish about enrolling in the program. I respond, after pushing number 1 on my phone, with Comprende GFY.
Selling a health insurance policy that does not exist? Sounds like insurance fraud to me. Do it twice and it’s a pattern of illegal conduct under Florida’s RICO statute.

This. I hope next time Trump says, its working its way through the courts...
Who will push the appeal?
