Despite federal judge’s ruling, Obamacare exchanges are open for business, CMS official says

A spokesperson from the Centers for Medicare & Medicaid Services told Fox News early Saturday that open enrollment for Affordable Care Act’s health insurance will continue despite the federal judge's ruling that the law is unconstitutional and must be "invalidated in whole.”

U.S. District Judge Reed O'Connor, a federal judge in Texas appointed by President George W. Bush, ruled that last year's tax cut bill knocked the constitutional foundation from under Obamacare by eliminating a penalty for not having coverage. The rest of the law cannot be separated from that provision and is therefore invalid, he wrote.

The decision came on the evening before the Dec. 15 deadline for Americans.

The spokesperson from CMS told Fox that the judge’s decision, which was applauded by President Trump, is still working its way through the courts and is not the final word on the matter.

"There is no impact to current coverage or coverage in a 2019 plan," the spokesperson said.

All this sets up is a Supreme Court hearing and their agreement....then you have the Nancy Pelosi ‘period’ to fix the issue. Considering the make-up of the Senate and President Trump...I’d say no repair will occur in 2019, and the health insurance apparatus will dissolve at the end of 2019. The entire primary season of 2020? All revolving around the ‘fix’ or resolution.

They are still sending endless enrollment emails saying that my time almost up.

As a tax payer who is forced to keep paying for non elected dictators I've had enough.

I am finding it difficult to understand the reasoning. How does eliminating the “tax” (penalty) make Obozocare itself unconstitutional?

Don’t get me wrong, I think the whole concept of Obozocare is unconstitutional because it forces people to buy something whether they want to or not, but I don’t understand how eliminating the tax makes it unconstitutional. Unsustainable? Sure.

I’m no legal or constitutional scholar, so I’m afraid I just don’t get it.

But when the conservative courts make a ruling, the leftists ignore it.

The exchanges may still exist, but they shall no longer have access to the original sources of funding for those applications that depend on subsidies for the applicant who falls into the class defined as eligible for assistance..

Otherwise, people now have the option to decline to carry coverage at all, without penalty from IRS, or they can still buy the “insurance” with its enormous deductibles and the right to carry a card, which they find is virtually useless in covering a good many of the ills with which they may find themselves afflicted, ending up paying out-of-pocket until they have spent themselves into penury.

That is a much more fiscally sound policy for just about everybody but the victim, er, Obamacare client.

So, they supposed to dissolve all the insurance contracts at the snap of fingers? What would be the fallout if millions went to bed with insurance and woke up without it?

We're supposed to be the side that thinks with our brains and not our emotions....

Selling a health insurance policy that does not exist? Sounds like insurance fraud to me. Do it twice and it’s a pattern of illegal conduct under Florida’s RICO statute.
