The entire basis on which Roberts corruptly upheld Obamacare was that the penalty was a tax and thus covered under the taxing power. Without it, the taxing power does not apply and therefore the bill has no constitutional basis (not that it ever did.)

The whole thing was a scam to enrich insurance and the medical field while allowing corporate to shift burden onto us.

The decision was based on the belief that the tax cut bill eliminated the penalty. It did not do that. The penalty was reduced to zero but not eliminated. It could always be increased to something more than that in the future. Under Roberts ruling, this is simply a tax cut, since he declared it a tax and the tax is still law. that will be his loophole to uphold Obamacare.
It would appear that Chief Justice Roberts either put the vise on his own privates with his earlier argument that it is a tax, or he designed it that way.
Either way, the previous ruling that it was a tax creates precedent and standard. Which means unless they find an emanation from a penumbra, the kraken known as OCare has suffered a fatal wound.
Until the Dems have all three branches of government again.
I suspect John Roberts knew what he was doing in going the ‘tax-route’, and inventing a way to easily dismantle it without a lot of theatrical garbage or Obama-payback. So here we are. Pelosi can’t repair this if the Supreme Court agrees on this issue, unless she works with the GOP Senators and Trump. In the 1970s and 1980s....you had legit Democratic leadership which were able to compromise and find agreeable terms with the GOP. That leadership doesn’t exist today.
I’m not sure whether or not healthcare is “a right” but I know I’m 100% correct when I say forcing someone else to pay YOUR medical bills IS NOT “a right”. That crap IS NOT in the U.S. Constitution.
