(Reuters) - A U.S. federal judge in Texas ruled on Friday that the Affordable Care Act, commonly known as Obamacare, is unconstitutional.
U.S. District Judge Reed O'Connor in Fort Worth agreed with a coalition of 20 states that a change in tax law last year eliminating a penalty for not having health insurance invalidates the entire Obamacare law.
O'Connor's decision is likely to be appealed to the U.S. Supreme Court.

The penalty itself was not lawful.
When someone doesn’t obey a rule the imposition is a fine, for which due process is guaranteed, and not a tax.
Roberts’ high handed lawlessness is a vehicle by which all due process can be hereafter denied: all they have to do is call the penalty a tax.

Don’t ask yourself if federal judges are conservative or liberal. They are neither. They are, above all else, FEDERALISTS! Any case that gives the Federal Government more power (or preserve what power they have) will win the case - each and every time.
That’s why Trump can fill the SCOTUS with nine “conservatives” and they’ll still uphold Roe v Wade. The same is true with Obamacare.
