Judge Napolitano is really sounding like a leftist these last few months. It sickens me to listen to him lately. He probably wants POTUS to pick him for the AG position. NO.
I never listen to Napolitano; haven’t for a couple of years. I’ll wait for what Jeanine Pirro has to say.

Napolitano is probably right on this. Keep in mind that he's not talking about "qualified" in subjective terms, but under the explicit Senate confirmation requirements of the U.S. Constitution.
How do I know he's right? Because he agrees with Clarence Thomas on this point. Thomas has been clear about this for a long time: the appointment of an "acting" cabinet member without Senate confirmation is an end-run around the Senate confirmation requirement.

Statute? Yes.
Constitutional powers of the President? Almost certainly not.
It's worth noting that there is probably nobody with any legal standing to challenge the appointment right now (other than the Senate itself, of course). That would only change if and when Whitaker performs some official function that he's required to do by law as the AG.
