The concept of first country of asylum (Trump is a Genius)

Introduction: International Standards

The concept of first country of asylum is defined in Article 26 of the APD:

A country can be considered to be a first country of asylum for a particular applicant for asylum if:

(a) s/he has been recognised in that country as a refugee and s/he can still avail him/herself of that protection; or

(b) s/he otherwise enjoys sufficient protection in that country, including benefiting from the principle of non-refoulement; provided that s/he will be re-admitted to that country. In applying the concept of first country of asylum to the particular circumstances of an applicant for asylum Member States may take into account Article 27 (1).

It should be noted that Member States are not required to apply the concept of first country of asylum, as Article 26 is a permissive provision.1

However, in accordance with the APD, those Member States which apply the concept are not required to examine whether an applicant qualifies as a refugee or for subsidiary protection status, where a country which not a Member State is considered as a first country of asylum for the applicant pursuant to Article 26.2

In other words, the Member State may consider such applications as inadmissible.

Trumps EO asylum only at port of entry,then released into Amer-weak? Should be asylum request have to be made at US consulates and you wait there not in America until it is decided. Asylum requirements also need to be tightened up

under Article 26(2)(a)‘reassignment’ (especially if first country refugees prove burdensome),
but ONLY IF the third move is safe from ‘refoulment’.

Donald needs to issue an immediate E/O......all refugees on US soil seeking asylum are to be returned to the country of origin from which they fled.

I think one of Trump’s biggest strengths is that he doesn’t listen to the political, social science & PR “experts that ring most presidents like some sort of human(barely!) planetary system. He listens more to people who do things, make things, build things etc. Read Hassim Nicholas Taleb books http://www.fooledbyrandomness.com/ on how we have for years suffered from a “tyranny of experts”! Basically since FDR its been government by political science grad “bull session” !

Mexico, for all it’s faults, did us a big favor in extending asylum to the refugees.

Don't kid yourself. Mexico is not that altruistic.

When advised they could get tons of UN money to take the migrants, the offer was too good to refuse.

I think they should tow some old Aircraft carriers 10 miles off the coast and helo the refugees to tent cities on the deck.

I heard last night that several Central Am countries are failing and are now experiencing serious infectious diseases such as measles, HIV, malaria, (I think they said Diphtheria) and Dengue. These disease are now presenting in countries 500 miles away from original country. This info was released yesterday in a report. Perhaps by the CDC. No sure, but it was released yesterday.

Big Question #1: Is the U.S. a signatory of the APD? My guess is that we can claim its provisions only if we have signed on as a treaty member.
