Self Defense in Texas: 22LR Single Shot Beats AR15 & .40 Cal

The gunfight happened in the early morning hours of 17 August 2018. The location was 867 Bootlegger Lane in Yoakum, Texas.  Yoakum is a small town in Texas, about halfway between San Antonio and Houston.

There was “bad blood” between Dakota Wayne Kirkman, 19, and Manuel Martinez III, 36.  The men lived about 22 miles apart. Yoakum is in DeWitt County, Texas. Kirkman and his girlfriend lived in Hallettsville in Lavaca County, Texas.

Dakota did not want his live-in girlfriend to hang around Martinez and his wife. His girlfriend, Martinez, and Martinez' wife were at Martinez' house when Kirkman came to bring his girlfriend home.  Kirkman arrived in his truck. He had a singleshot .22 rifle and one cartridge, loaded in the chamber.

Kirkman and Martinez got into a verbal altercation. The Sheriff reported that alcohol was involved.

The altercation escalated into a gunfight. Cartridge cases found at the scene indicated that Martinez fired 15 shots from an AR15 type rifle and 12 shots from a .40 caliber pistol.

Most of the action seems to have happened while Kirkman was in or around his truck. 13 bullet holes were found in the truck. 11 of the bullet holes were from  .223 cartridges. Two of the bullet holes were from a .40 caliber pistol.

Kirkman is recorded as firing one shot from his single shot .22 caliber rifle. The shot struck Martinez in the chest, killing him.

Amazing how often, especially shooters, forget this and get caught up in weapons, which one is more accurate, better etc. etc. Hickok45 of youtube fame and someone who can hit a vollyball at 300 yards with iron sights made a very profound statement. When discussing this issue of which gun is most accurate he pointed out that virtually any modern firearm (the discussion was about rifles) "can shoot better than I can. I am the limiting factor on just about any rifle I shoot. They pretty much all work like they were designed to" He's absolutely right. The time you spend at the range, not the weapon, is what makes you an effective shooter.

I’ve read a number of articles about this incident (not just the one linked to on Ammoland) and a couple things stand out at me. For one, Kirkland’s (the one shooting the .22) girlfriend is the sister of the deceased’s wife. Second, alcohol was involved (never said who was drinking, just that alcohol was involved) - my guess from grand jury verdict would indicate that it wasn’t Kirkland who was drinking. Third, Kirkland did himself no favors by leaving the scene after the shooting with his live-in girlfriend in tow before cops arrived - I suspect that contributed to the high bond being set, at least compared to if he had stuck around long enough to tell the cops on scene his side of the story.

Lastly - I hope Kirkland (or his g/f) have the common sense to realize that them being a couple isn’t such a good thing.......

I thought that the teenager was the one with the 22.

I saw a reference to that. Can't say it is so or not. One article was not even sure if Martinez was married or not.

My suspicion is that the two women are sisters.

Yes, it would have been better if he had stayed at the scene.

At 19, I do not know if I would have done as well or not.

55 days in the slammer would be hard on a relashonship, as would shooting a girlfriend's, sister's husband...

Amen to that. Marine rifle training preaches this rule all the time. It’s not how many rounds you can send down range, it’s how many hit the target. Rifle fire discipline tactics teach you to conserve your ammo and not waste it. Ammo conservation is one of the lost disciplines today, brought about by the auto/semi-auto firearm - spraying lead everywhere with few results. This does not mean there aren’t times when rapid fields of fire are appropriate.

My bet is very few, maybe none.

A .22LR to the sternum has to be incredibly painful, and may have rendered him unable to function long before he bled out.

One other observation: angry people will often shoot at *things* if they don’t have a clear human target. This wastes ammo and identifies their location.

A calm, rational shooter will only shoot at an identifiable, hostile human target.
