Supreme Court allows North Dakota to enforce voter ID laws
The Hill ^ | 10/09/18 | LYDIA WHEELER

Posted on 10/09/2018 3:38:04 PM PDT by yesthatjallen

The Supreme Court on Tuesday refused to toss out an appeals court order that allows North Dakota to enforce its voter ID requirement during the 2018 elections.

The request to toss out the order came from a group of Native American residents who are challenging a new state law that requires voters to present identification that includes a current residential street address.

The challengers argued the new rule disenfranchises a disproportionate share of the population because many Native American voters live on reservations with no street addresses.

The District Court agreed and temporarily blocked the state secretary from enforcing the new requirements during the primary elections, but the Eighth Circuit Court of Appeals blocked that court order last month.

The challengers asked the Supreme Court in an urgent request submitted to the Justice Neil Gorsuch to toss out the Eighth Circuit stay, arguing it has left thousands of Native American voters unable to cast ballots, but the court denied the request without explanation.

The Court's newest member, Brett Kavanaugh, did not take part in the decision.

Justice Ruth Bader Ginsburg, however, filed a dissenting opinion, which Justice Elena Kagan joined.

Ginsburg said she would have granted the challenger’s request. She said last-minute court orders affecting elections, especially conflicting orders, can result in voter confusion and keep people from turning out to the polls.

“The risk of voter confusion appears severe here because the injunction against requiring residential-address identification was in force during the primary election and because the Secretary of State’s website announced for months the ID requirements as they existed under that injunction,” Ginsburg said.

“Reasonable voters may well assume that the IDs allowing them to vote in the primary election would remain valid in the general election.”

Well, seems to me the Reservation Council needs to start naming their streets and assigning addresses. Problem solved.

A nation without borders and without strict, yet reasonable, voter "checks" soon ceases to be a nation.Because just about every election effects the entire country there should be a Federal law regarding voter registration, voter ID and voting fraud.

Certain violations of such laws should earn the individual 10 years at Club Fed.

I could be wrong, here, but I doubt if Ginsberg “said” anything. I doubt she can dictate or type, let alone hand write anything. Her law clerks are most likely doing this on their own, with her nodding her head...when she’s able.

“The Rez”—that reminds me of one of my all time favorite TV series, “Longmire.” :0)

In Arizona, when I was looking at the part where you put your street address, you can also just put the latitude and longitude (or something like that) in case you live in a hogan in the middle of nowhere or have your trailer parked in the mountains or something.

You mean actually solve the problem instead of letting it fester and be prolonged? Innovative. I wish government thought like that.

Sounds reasonable, from Vote.nd.gov: Requirements for Identification (NDCC § 16.1-01-04.1) ➣ Identification must include the voter’s: Name Current North Dakota Residential Address Date of Birth Acceptable Forms of Identification: ➣ Voting at the Polling Place – A Valid North Dakota: Driver’s license Nondriver’s identification card Tribal government issued identification (including those issued by BIA for a tribe located in North Dakota, any other tribal agency or entity, or any other document that sets forth the tribal member’s name, date of birth, and current North Dakota residential address) Long term care identification certificate (provided by North Dakota facility) ➣ Supplemental Documentation If an individual’s valid form of identification does not include the North Dakota residential address or date of birth, or the North Dakota residential address is not current, the individual may supplement the identification with a current utility bill; a current bank statement; a check or a document issued by a federal, state, local, or tribal government (including those issued by BIA for a tribe located in North Dakota, any other tribal agency or entity, or any other document that sets forth the tribal member’s name, date of birth, and current North Dakota residential address); or a paycheck. ➣ Set Aside Ballot Option If an individual is not able to show a valid form of identification but asserts qualifications as an elector, the individual may mark a ballot that will be securely set aside. When the individual provides valid identification to the proper election official prior to the meeting of the canvassing board, the set aside ballot will be presented to the canvassing board for proper inclusion in the tally.

I just looked up South Dakota’s voter registration law and form. This article is lying. There is nothing there that prevents a person from using a p.o. address, such as a rural address would have. Just another democrat stunt to try to allow illegals to vote.
