What Counts as Witness Tampering?

The Wall Street Journal reports:

A friend of Christine Blasey Ford told FBI investigators that she felt pressured by Dr. Ford’s allies to revisit her initial statement that she knew nothing about an alleged sexual assault by a teenage Brett Kavanaugh, which she later updated to say that she believed but couldn’t corroborate Dr. Ford’s account, according to people familiar with the matter.

Leland Keyser, who Dr. Ford has said was present at the gathering where she was allegedly assaulted in the 1980s, told investigators that Monica McLean, a retired Federal Bureau of Investigation agent and a friend of Dr. Ford’s, had urged her to clarify her statement, the people said.

This may explain why Keyser ended up in the rather silly — not to mention legally convenient — position of saying that she believed Ford, but also couldn’t remember any of the incidents that she supposedly saw.

This revelation has prompted many to suggest that McLean is guilty of witness tampering. Is she? Well, maybe. But it would be a heavy lift. 18 U.S. Code § 1512 holds that one is guilty of “tampering with a witness, victim, or an informant” if one “knowingly uses intimidation, threatens, or corruptly persuades another person, or attempts to do so, or engages in misleading conduct toward another person.” Moreover, this law applies to those who “influence, delay, or prevent the testimony of any person in an official proceeding.” Per § 1515(a)(1) “a proceeding before the Congress” counts as an “official proceeding.”

But the language in 18 U.S. Code § 1512 is “corruptly persuades.” Was McLean’s effort “corrupt”? That, I think, would be much harder to prove.

Ford is not some innocent but is part of corrupt political plot. Ford said her friend did not remember the incident because of health issues. Did the FBI ask Keyser if she had any health issues interfering with her memory?

Activist Robert Reich, who served as Bill Clinton’s Secretary of Labor, sent out a blast email on behalf of MoveOn.org on Thursday asking for donations to fund “MoveOn’s emergency campaign to stop Brett Kavanaugh.”
In the email, MoveOn.org, which has been massively backed by billionaire George Soros, warned the group’s anti-Kavanaugh plot is set to include “direct actions in Washington, D.C., at Senate office buildings, including busing in constituents from key states.”

The radical organization also wrote in the email it was planning to...ETC

On Saturday, Politico reported (LINK) on progressive groups, including MoveOn.org, making a “last-minute push to stop Kavanaugh.”...

Besides funding from Soros, MoveOn.org has also been financed by the Tides Foundation, a leftwing sponsorship organization that has itself received donations from Soros and has partnered with Soros’s Open Society Foundations.

My personal opinion is that Ford is a hateful, spiteful woman lying to push an ideological agenda - all while deluding herself and rationalizing that lying and destroying Kavanaugh’s life is OK, because it's for the greater good. His wife and children? Well, they are guilty of white privilege, right?

I don't see how we can reconcile these two sides of America.

I wish we as a society would bestow honors upon this friend who refused to lie. If feminism was a sane pursuit, this is a prime example of an empowered woman standing up not just for women, but for what is right and honorable in humanity.

Don’t want to oversell it, but Keyser (based on her photos recently) does seem to have some health issues and it would have been easy for her to cash in on this circus by “just fudging a little.” Where is her Go Fund Me?

Per the article, it would be a heavy lift to go after McLean on this, but it certainly applies more clearly to Feinstein and her staffers - they certainly influenced (directed Ford to anti-Trump Democrat activist, Deep State attorneys) and delayed (at a minimum) Ford’s testimony before the Judiciary Committee, plus they leaked confidential information:

I agree that under some extreme circumstances it is morally right to defy the lawful actions of the state. Gandhi and German saboteurs in WWII come to mind. However, with the insufferable self righteousness of the left today, every issue is Selma and it’s ALWAYS right to do anything to vindicate what you perceive as the greater good. It’s only Cloward-Piven (so) for some of them. For most it’s their self righteous smug Superior attitude that drives them

This would hold in the normal world in normal but we are living in the Deep State Bizzaro World era of political warfare and a strangely inverted version of Soviet style show trials where the political holdovers from the previous administration are fighting a seditious rear guard action to remove the elected President and regain the power the so badly abused while in office.

If we use the Robert Mueller standard of justice, the pond scum that conspired to turn Brett Kavanaugh’s Supreme Court nomination into libelous chaos deserves 5am no knock raids by armed FBI agents because the Trump campaign members have been harshly persecuted for false offenses manufactured by Obama Era holdovers DOJ and FBI - many of whom are associated with the same close knit network of operatives who worked to derail the Kavanaugh nomination. .

QUESTION: Why was an FBI friend of Ford allowed to talk to witness about this accusation? Sure seems to be a biased investigation to me.
