Sen. Jeff Merkley asked a court Thursday afternoon to quickly step in and delay the Senate from voting on this weekend on Brett Kavanaughs nomination to the Supreme Court.
Mr. Merkley has filed a long-shot lawsuit arguing President Trump has violated the Constitution by withholding documents from Judge Kavanaughs past, denying senators the ability to make an informed decision on the nomination. That, he says, violates the Constitutions demand that the Senate give advice and consent on nominations.
The Oregon Democrat asked for a hearing Friday afternoon or Saturday morning, just before the Senate is expected to hold a final vote on the judges elevation.
Once the vote is taken, plaintiffs ability to comply with the Constitutions advice and consent process will be permanently extinguished, the senators lawyers wrote to Judge Amy Berman Jackson, an Obama appointee to the federal district court in Washington, D.C.
Judge Jackson on Wednesday scheduled a hearing for next Tuesday, after all sides had a chance to submit briefs.

They are completely unhinged, severed from all contact with reality. The demonicRATs are now spinning off wildly into previously uncharted realms of madness, from which there is no returning.
They tried character assassination against Kavanaugh.
Literal assassination is not far away.
They’re perfectly willing to burn America to the ground in the hope of ruling over the ashes.
That would appear to be their trajectory and given its delusional nature I don’t see them self-correcting. Self reflection only reinforces them now as they have replaced reasoning with a zealous moral certainty. It’s basically the same as the muslim jihadi mindset with a different story line as the framework. They have transitioned from stalwart ideologues to true believers in the cause. I suspect that even the outcome of it all has become secondary to that.
