An Upper West Side philanthropist who was nearly killed by a shopping cart that was tossed by teens from an overpass won a $45.2 million jury award Friday and said she plans to donate a portion of the money to a local youth center.
Victim Marion Hedges, 53, shook with emotion when the verdict was announced but she didnt shed a tear because a side effect of her brain damage is the inability to cry.
She then stood and applauded the jurors before they left Manhattan Supreme Court.
Its been a long, long road, Hedges said.
Hedges and her son were buying Halloween candy for poor kids on Oct. 30, 2011, at the East River Plaza mall in East Harlem when the teens tossed the cart from a 79-foot-high landing outside a Target store.
Hedges suffered severe brain injuries when the cart knocked her to the ground. But she never blamed Jeovanni Rosario, 13, and Raymond Hernandez, 12, who were behind the incident. Both teens were sentenced to time in juvenile facilities.
I just want to be able to do something with the money that helps kids in Harlem, I really do, Hedges said after the verdict, specifying that shed like to support the Johnson Community Center on East 113th Street.
We want to help Harlem kids have a chance to do something besides throw a shopping cart on a boring Sunday afternoon, she said.
The judge was wowed by the Manhattan moms attitude throughout the case.

No, of course not. Who would actually blame the kids who literally threw the shopping cart on top of them. The cart should have stood its ground and resisted. Erm. I do believe they deserved more than to just spend a little time in “juvie.”

I also think she's an idiot. A lot of "good people" are ruining this country. And a lot of them are of my sex, unfortunately.
And I also don't agree with the lawsuit at all. The people that actually do these things are very often not made to suffer enough with loss of freedom nor financial suffering. I know they were kids so they don't have deep pockets, but what they did is no one's fault other than theirs.
I'm glad they are appealing and she can stuff "her" charity. It's charity with someone else's money...just like the left always does. Easy to have a bleeding heart when someone else is footing the bill.
Sure, blame the store and security, I’m surprised that Isaac Newton wasn’t partly to blame, he discovered gravity.
Kids who murder or attempt murder should not get more lenient treatment. Murder is murder and theres no distinction about different punishments by age with respect to murder.
It means no real justice for the other people, usually adults. They rob a family of a parent, the rob other kids from their parents. The adults life is less if they dont get the proper sentence for murder.
This is why gangs have had minors do murders. This is why some kids decide to murder someone, they know they get just a few years in juvenile and have their records sealed.
It demeans the victims. the victims aren’t worth as much and dont get justice. they are gone forever because of the age of the murderer. not right. never has been.
