WASHINGTON—An eight-member Supreme Court, divided by ideology and clouded by uncertainty, returns for a new term Monday, facing a docket of workmanlike disputes while senators battle over nominee Brett Kavanaugh’s confirmation in the face of sexual-assault allegations.

The court’s calendar features cases on endangered species and excessive fines, as well as litigation over sex-offender registration that could have broad constitutional ramifications. There is also an improbable appearance for an Alaska moose hunter who is making his second trip to the court.

Senate Republicans had intended to confirm Judge Kavanaugh in time to provide a fifth conservative vote by the start of the term; without an ideological majority, the court likely will take only modest steps.

Elena Kagan Lied To Legalize Partial Birth Abortion In USA

According to Dr. Yoest, when the partial-birth abortion issue (PBA) came up for discussion in the Clinton White House where Kagan was working, the American College of Obstetricians and Gynecologists (ACOG) said they "could identify no circumstances under which [partial birth abortion/D&X] procedure....would be the only option to save the life or preserve the health of the woman."

The AUL report cites a memo where Kagan called ACOG's definition "a disaster" in light of the Clinton Administration's policy work on the matter. Later it was discovered that Kagan actually added a sentence to ACOG's definition, with the effect of profoundly altering the meaning of the ACOG statement.

Her sentence, which followed the original ACOG statement (above), said: "An intact D&X, however, may be the best or most appropriate procedure in a particular circumstance to save the life or preserve the health of a woman."

Apparently, ACOG's Executive Board accepted the addition, without input from their organization's "select panel" (which had drafted the original medical report on PBA), and without a vote from members of the organization. The additional language Kagan added to ACOG's definition remained an important part of the defense of partial-birth abortion from that point forward, and was used by those who filed suit against state partial-birth abortion bans in the years that followed.

During the recent confirmation hearing for Kagan, Sen. Orrin Hatch (R-UT) was clearly disturbed by these revelations. He questioned Kagan about them, and she essentially told the Senator that she doubted that her involvement had influenced ACOG. Yet the AUL report makes it clear that Kagan did, in fact, lobby ACOG while working for the Clinton Administration.

and don't get me started on Sotomayor's "wise Latina woman" issues.

Judge Kavanaugh’s appointment is a lifetime placement. It will be worth it if he is confirmed.

I believe he will be.

The Constitution doesn’t say anything about terms or specific calendar dates concerning the Supreme Court.

Or did I miss something in Constitution?

THE LEFT HAS WON, PEOPLE.

Any case the Supreme Court takes right now could conceivably end up split 4-4, and therefore the lower court decision STANDS. This could end up enshrining all kinds of Demonrat tyrrany: rifle "assault weapon" bans, refugee infloods, anything they want.

And the Demonrats will KEEP THE DELAYS UP until they win in November (so they think), so that they can shut down ALL Trump judicial nominees after that.

This should be laid DIRECTLY at Grassley's & McConnell's feet. THEY HAVE BETRAYED US to the Left.

I’ll tell you why: because I want people on our side to be upset that they LOST and get mad and fight back. I want our side to punch back against the Left, not treat them like people with different opinions on other side of the aisle. We have to realize that the Left has bloodied our nose and left us bleeding, that we are in a street fight not a debate club. We have to realize we’ve lost a battle to motivate us to fight back.

Nonsense.

Clarence Thomas wasn’t seated until Oct. 15.

Won’t affect one thing. K will be able to review all cases and, if a new oral argument is needed, it MUST be provided.
