Betsy DeVos plans to change the way sexual assault is investigated on college campuses - calling the current guidelines 'skewed against the accuser' in the wake of Kavanaugh case.
Education Secretary Betsy DeVos is considering new guidelines that could dramatically change the way allegations of sexual violence are investigated on college campuses.
DeVos says the system put in place under President Barack Obama is skewed against the accused. She's expected to issue new rules in the near future.
This comes after the dramatic Senate testimony last week by Dr Christine Blasey Ford who claims Supreme Court nominee Brett Kavanaugh sexually assaulted her in high school.
At stake is whether schools should require higher standards of evidence when handling complaints and whether both parties should have access to that evidence.
DeVos has said she wants to honor the rights of the victim and the accused
Also under review is the use of mediators and the possibility of the accuser and the accused cross-examining each other.
DeVos' new guidelines are expected to address whether schools should have to investigate as soon as they are aware of alleged misconduct or only after a student files a formal complaint.
The Department of Education declined to comment Friday about DeVos' plans for revising the sexual assault rules.
But when issuing temporary guidance last year, DeVos said she was looking for a more balanced approach.
'Every survivor of sexual misconduct must be taken seriously. Every student accused of sexual misconduct must know that guilt is not predetermined,' she said in September 2017. 'These are non-negotiable principles.'
Many victims of sexual violence never take that step. Dr Ford did not and only acted decades later when she learned that Kavanaugh was on a short list for the Supreme Court.

I know she ‘declared’ CC to be dead. However the schools still use it, still collect intrusive data on the students and indirectly on the students’ families.
Last I heard shortly after President Trumps inauguration, they were going to do a ‘study’ for 300 days and revisit the issue then.
Get rid of the liberal brainwashing in public education and universities, and you’ll automatically fix a number of problems.

And I don’t know how to do this other than through human judgement, but for pete’s sake, separate true assault from consensual arrangements where one party later decides to use it for revenge. This is hard to prove because the “victim” can probably pass any number of polygraphs swearing that that it happened - because it did - but that they suppressed it - until it served their purposes.
Sorry, but this won't work in your grandson's favor, believe me.

Because Jimmy Carter proposed a Department of Education which was founded by congress in 1979 seizing power over education from the states and turning it over to the Fed’s. That’s why.

Hey, here’s a really groovy keen idea...How about instead of letting campus security and some darn administrators handle cases of sexual abuse, we ALLOW and encourage the victim to file a police report with local law enforcement?
I used to work at our local community college (OHC-Out Here College). Administration did everything they could to keep local law enforcement out of the loop. Why? So they could report 0 rapes on campus..because no rapes were reported to the State or the local LEs. Oh, yes, we had rapes..but they were handled on campus...wouldn’t want Suzy’s mom and dad to know that Suzy might be in danger. Also, wouldn’t want rich Uncle Bill to leave OHC out of his endowments section of his estate plan.
We must not automatically believe the victim. We must have all the facts, not just the ones the victim presents. And the accused has the right to see the evidence and confront his accuser. There are many victim advocate systems who are there to specifically help the victim thru the legal processes.

Well the colleges took Federal money and that was all the power crazy Deep State needed to make it a Federal issue.
It is about time that due process is re-introduced to college campuses where, under Title IX, men (most often) have not had the ability to fight back against an accuser. Even in Washington, Dianne Feinstein and her ilk seem to be playing by Title IX rules. They must change.
