An emerging coalition of New York municipalities is preparing to challenge proposed Internal Revenue Service regulations that clouded the ability of cities and towns to set up funds that allow residents to pay their local taxes as charitable contributions.
The group of municipalitieswhich includes Westchester Countywill file public comments with the IRS and is considering a lawsuit, according to Assemblywoman Amy Paulin, a Democrat who lives in Scarsdale.
The new federal tax code signed into law by President Trump in December put a $10,000 cap on state and local tax deductions, a change that has hurt some residents in New Yorks high-tax suburbs.
State lawmakers approved a bill in March that allowed the creation of the charitable funds. Under New Yorks lawwhich is similar to legislation adopted in New Jersey and Connecticutlocalities can issue a taxpayer a credit against their property taxes for up to 95% of the amount donated to a designated charitable fund. New York may issue credits against state income tax for up to 85% of a donation.
Representatives for the IRS and Treasury Department have said they are reviewing the suit.

I would suggest they pay one of their already bought judges to declare the law to be unconstitutuinal. And then, they must not pay taxes such that when they lose, they will then need to pay penalties and interest.
Because the other 49 should be made to pay for the mess we’ve made.

It’s easy to raise taxes when you can get someone from another state to subsidize it. Why should those of us living in Kansas pay for well heeled New Yorkers in Westchester County? These kind of stuff is why I never vote for a Democrat.
A tax is a TAX. It is not a donation. Donations are voluntary. Are people in these areas allowed to voluntarily NOT donate their taxes?
And no, I didn’t read the article, but this makes no sense to me!
If a citizen genuinely wants to give money to a local government on a purely voluntary basis--then I think that could be counted as a charitable contribution.
Of course, idiot judges have ruled that the Government can make you buy health insurance.

It makes a lotta sense. NYS is bleeding makers. Rumor has us losing one to two House seats after the next census. And this has been happening for consecutive DECADES. We’re replacing makers with takers and losing the ability to appear to pay for our sodding welfare state.
This is a desperate last gasp, possibly to fend off po’d high end property owners who can be conned because they’re venal and stupid. They may be trying to keep them here a little longer.
The IRS Tax Law has a doctrine of substance over form that disallows such sham transactions.
An honest judge with a little grit will rule as above, and then rule that since these municipalities want to turn their property taxes into "contributions," their citizens are at liberty to decline to contribute.
Just how ignorant (and stupid) do these pandering political hacks think the voters are, anyway?
Please don’t tell them to move. They just infect their new homes with the same bullsh*t. Keep them where they are. In fact, get them to tell all their friends, family and neighbors that have infected Georgia to move back, as soon as possible. They’re ruining the place.
