Trump chips away at liberal U.S. appeals court majorities

Aided by fellow Republicans in the Senate, President Donald Trump is rapidly filling vacancies on U.S. appeals courts, moving some that had liberal majorities closer to conservative control in an ideological shift that could benefit his administration.

These 13 courts wield considerable power, usually providing the last word on rulings appealed from lower courts on disputes involving federal law.

Their rulings can be challenged before the U.S. Supreme Court, but most such appeals are turned away because the top court typically hears fewer than 100 cases annually. Eleven of the courts handle cases from specific multi-state regions, one handles cases from Washington, D.C., while another specializes in patent cases.

Presidents can reshape the federal judiciary with their appointments and seek to appoint judges they believe share their ideological leanings. Republicans typically strive to pick conservatives while Democrats generally aim to appoint liberals, all subject to Senate confirmation.

Although there are no guarantees a judge will rule the way a president might like, the number of Republican and Democratic appointees is generally an indicator of an appeals court’s conservative-liberal balance....

Their only chance to set policy is through the courts.

Since they don’t win at the ballot box.

Here’s why thats important. (and I’m not a lawyer, so correct me if I’m wrong).

Lets say somehow the Dems manage to derail Kavanaugh. And then take control of the Senate and keep that seat empty until 2020.

The increasingly Conservative courts from below will render increasingly more constitutionally based decisions from below. And if they DO make it to the Supreme Court.... there will be a lot of 4-4 ties. Which means the (hopefully) conservative decisions stand.

I’m very happy President Trump has managed to push through 26 nominees on the Appeals courts so far but that’s still only half way toward undoing the damage Obozo did with his 55 appointees. There are a few districts like the 4th and 11th that could be flipped back with just one more appointment. If Trump gets re-elected in 2020 it will be huge for replacing some of the Gang of Four on the Supreme Court as well as cancelling out Obozo’s influence on the appeals court.

The very good news is that those 26 are in the first two years, 6 of 13 open appeals courts seats have Trump nominations under consideration, so by the end of Trump’s first term he should have at least 39 appointees in place. As long as R’s retain the Senate, and with the filibuster gone, Trump should far exceed Zero’s numbers by the end of his second term.

The Supreme Court is still the big prize - and after Kavanaugh is confirmed the big battle will be when one of the four full liberal justices dies (none will retire while Trump is President). The lib’s are going crazy over a shift from soft conservative to conservative with Kavanaugh - the next appointment will truly change things and the fight we are seeing now is nothing compared to what’s coming.

But they hope to turn it around in the first midterm after a new POTUS is sworn in. The hate against Trump is undeniable.

I have some friends who came legally from India, and in their view CNN is the channel to watch. They have 2 daughters who are Hillary fans. I told them that if they want a democrat, Tulsi Gabberd is much better than Hillary.

Maybe they will figure it out eventually.

Good, that’s part of why I voted for him - to restore some sanity and balance to the courts. I’m way tired of the courts being the 2nd legislature for the Dems, and them always controlling the courts to thwart the will of We the People.

Oh, and that bit about “to benefit his administration” is a bunch of Leftist hogwash. It will benefit this country, long after the Trump administration’s 8 years are just a fond (REALLY fond) memory. That’s why Trump is doing this, not to benefit him personally - that’s what these morons don’t get. A multi-billionaire near 70 isn’t going to run for office for personal benefit...personal benefit would be to keep making more money and enjoy the heck out of life while trying to avoid entanglements with the arseholes in government.
