Rosenstein doesn't even have to be fired. The position of Deputy Attorney General was never established through legislation by Congress. It was created internally within the DOJ through an executive branch memorandum back in the early 1950s.

President Trump could issue an executive order tomorrow that changes the Deputy AG's responsibilities so that he's only responsible for overseeing the janitorial staff at DOJ headquarters.
