Vernon Unsworth, the caver accused by Elon Musk of being a pedophile, filed a defamation lawsuit against the Tesla CEO on Monday.

He might win in the UK, but doubtful in the US. He made himself a public figure, which would make a win difficult here.

Unsworth criticized Musk’s sub as a PR stunt and Musk acts like a 4th grader.

I think he’s got a good chance to prevail in the US; Musk made a specific accusation which carries a heck of a lot of onus, especially in the middle of rescuing youth. If it had been ‘acts like a’ instead, I think Musk would be clear.
I’m thinking someone missed their phone call to put forward a settlement package and that this will swiftly be corrected. Especially with the sorry not sorry apology.

He has an excellent lawyer! I think Musk will settle (undisclosed terms) but Mr. Unsworth should be set for life.
A few points as to your observation.
1. Musk made him a public figure. He wasn’t really one before, particularly in the US. (Can you name off the top of your head, any of the other rescuers?
2. The publications were libel per se.
3. Even a public figure can sue if there is actual malice. Musk has laid a pretty good framework upon which the trier of fact could reach such a conclusion.
Going back to the Public Figure issue - most folks would concede that Wally Butts and Bear Bryant were pretty well known back in the day. Butts won against the Saturday Evening Post (well, the parent company).
And Sullivan, Butts, and Herbert were tailored to protect the corporate media. Here, there’s an individual (although one with ties to the deep state) on the other end of the suit.
It wouldn’t shock me if Musk rode into space on his rocket, then opened the door planning to walk out.
That was a good find.
The settlement (if there is one, Musk may refuse) will be small by Musk standards.

in the US it is almost impossible to sue for libel, but he has a good chance of winning in the UK.
It is a huge stretch to conclude that he made himself a public figure to the extent that he would be precluded from suing for defamation. Public figures for that purpose are folks who make their livings by being in the public eye, such as actors, musicians and politicians. The idea is that when you decide to make your living by putting your face in the public arena you have to take the bad with the good. This guy was not one of those people. Also, even public figures can successfully sue for defamation if there was actual malice. I wouldn't want to be Musk's attorney trying to defend him in court, US or otherwise. That said, it will settle well before it gets to court.

We’ll find out how fast the highest end modifed Tesla will go.
