Supreme Court nominee Brett Kavanaugh questioned in 2003 if Roe v. Wade was "settled" law during his time in the White House counsel, according to emails given to the New York Times.
Kavanaugh, in an email obtained by the newspaper, proposed deleting a line out of the draft of an opinion piece that said it is widely accepted by legal scholars across the board that Roe v. Wade and its progeny are the settled law of the land."
Kavanaugh, according to the email, questioned if legal scholars did agree that Roe v. Wade, the landmark 1973 ruling that established the right to an abortion, was settled.
"I am not sure that all legal scholars refer to Roe as the settled law of the land at the Supreme Court level since Court can always overrule its precedent, and three current Justices on the Court would do so," Kavanaugh wrote according to the Times.
The email was part of a batch of "committee confidential" documents given to the Times. The "committee confidential" blocks the emails from being released or discussed publicly.
I am happy to, no longer, be a resident of NJ. My family had lived in New Jersey since the late 1600’s, but my generation was the last to live there. It is a mess, financially, tax wise, education wise and politically. Bye!
Its silly.
Legal scholars widely dispute Roe as a decision. Grasping at straws.
Dems have nothing. Theyve lost this one.
The question is whether something will stampede Susan Collins and Lisa Murkowski.
All law is “settled” - except for laws liberals don’t like- like laws guaranteeing your right to bear arms.
But your ‘right’ to abortion? That’s settled.
So Booker would like the 19th century SCOTUS ruling about Jim Crow to be reinstated?
I thought the law, like the Constitution, is a living fluid changing thing. At least that’s what the leftists always say.
Here today; gone to Maui.
Well, Plessy vs. Ferguson was settled law - separate but equal - until it was not.
I don’t even understand the term “settled law” since anything that is done can be undone.
Political wisdom all these years is for R politicians to try to stay away from the abortion issue, it would do my heart good if we did an about face and refused to appoint people that in any way support abortion. I am sick of the left making this a deal breaker and we try to avoid it like the elephant in the room.
Of course I am no political expert by any means but the left supports their issues all the way with no backing up and so many times we act embarrassed to be straight forward about our issues.
